You *do* know that the thread is about men removing a condom in the middle of sex without informing their partner, right? Yes, that IS sexual assault.
What about a woman who lies about using birth control or taking a diaphragm and punching decent sized holes in it and getting pregnant that should also be rape fair is fair and they should go to prison like a man would and be registered as a sex offender for life.
First, prove it by producing the prophylactic used (even if only initially) during the specific act causing the pregnancy; do women really save these and mark them in an evidentiary manner for future prosecution? Can a women tell if the sheath has been removed during intercourse? Does she have any responsibility to tell the individual "No, Stop this act because of what you whipped off from what you whipped out?!" I thought the OP also included "sabotage?" A real whodunnit. What of the circumstance where the woman provides the holey prophylactic? My quote is an objection to the potential for the claim of assault due to pregnancy alone. If a woman becomes pregnant while her sex partner has no desire for that pregnancy may he file a charge of sexual assault? I ask because if the conception by the mother to be is due to intent, a process or product failure should the standard/law be applied when a woman finds herself pregnant at the objection of the sexual partner she willingly had intercourse with KNOWING he did not want children? Or when it is a woman she gets a pass on pregnancy over the objections of her sex partner (maybe because pregnancy is the natural result in sexual intercourse)? A slippery slope indeed. SIMPLE BOTTOM LINE; Don't have intercourse with anyone you do not want to be a parent with.

Foxxy, I have been spot on in opinion and in response. No, I see abuse and manipulation with this subject matter against the male of the species. The woman becomes pregnant when the prophylactic failed. Why isn't it sexual assault if the woman becomes pregnant when her partner does not want her to be with child? She's pregnant in both scenarios yet only the male is to be pursued.
This is the attitude of many liberals. A more conservative attitude would be: "Well maybe I should be a little bit careful about who I have intercourse with because we might have a pregnancy" I hear many people talking about it like it's a right to be able to have vaginal intercourse without there being any risk whatsoever of having to go through with a pregnancy.
I am not liberal, I am conservative. The govt. has no business telling me who, when or how I have sex. Nor does it have any business dictating what medical procedures I can or cannot have.
