A simple, common sense gun control plan

    Section 1) Require universal background checks
    a) With an exception made for firearms passed between family members, all gun sales will require a background check. Any background checks that come back with a "red tag" (more on red tags in Section 4) will mean that the person being checked is not allowed to purchase a firearm.
    b) No "gun show loophole". The background check rule will apply to any and all gun sales, except for sales between family members as mentioned in Section 1a.
    c) Since the cost of background checks can be expensive (depending on the state), the cost for background checks would be higher for professional dealers, but a smaller fee would be charged for amateur folk who are selling a firearm.

    Section 2) Establish Federal Gun Registry, and create "gun titles"
    a) A registry will be established at the federal level. Serial numbers of ALL firearms sold after the rule takes effect will be entered into the Federal Gun Registry.
    b) In addition to this, firearms will now come with a "gun title", akin to car titles. These gun titles will tie a specific firearm to a specific owner.
    c) Whenever a licensed gun dealer sells a firearm, they will be required to transfer the gun title from themselves to the buyer. When purchasing used firearms, licensed gun dealers will be required to transfer gun titles from the seller to themselves.
    d) Personal, unlicensed gun sales (if allowed by your state) would not REQUIRE an official transfer of gun title ownership, though it would be in the best interest of the seller to ensure such a transfer takes place. This will make it easier to track any firearm used in a crime to its last legal owner. It would also encourage people who lose their firearm or have them stolen to report the loss/theft quickly to authorities.

    Section 3) Require gun dealers to keep track of their inventory
    a) All licensed gun dealers will be required to take an inventory of their stock once per year, and report any and all missing (or unaccounted for) firearms to authorities.

    Section 4) Red tags
    a) There will be four main mechanisms by which an individual can receive a "red tag", which would mean an automatic fail of any background check:
    i) A person is convicted of a violent crime.
    ii) A personal is deemed a danger to themselves or others by a mental health professional.
    iii) A person has an active protective order against them.
    iv) Law enforcement at either the state or federal level has shown that a person poses an imminent threat. Law enforcement would be REQUIRED to get a judge to approve the red tag, much as law enforcement must get a judge to approve a search warrant. The red tag would only be valid for a reasonable, predetermined period of time, at which point law enforcement would have to show cause for continuing the red tag, and a judge would have to re-approve it.
    b) A red tag can be taken off of a person's record in a number of ways, depending on how they received it:
    i) The violent crime they were convicted of is overturned or expunged.
    ii) A follow-up with mental health professionals leads to a new assessment that the person is mentally fit and no longer a danger.
    iii) A protective order is lifted or expires.
    iv) Law enforcement decides that the person is no longer an threat, or cannot show cause for a judge to re-approve the red tag after the initial "red tag period" has ended. Also, an individual with such a red tag would be able to argue for its removal in court.

    Everything that has been presented by yourself is nonsense, with nothing being simple in terms of execution, nor qualifying as being "common sense" in nature. It is nothing more than the same tired, discredited ideas that have been demonstrated as serving no legitimate purpose that would justify their existence, and present no crime fighting benefits. Absolutely everything that has been proposed by yourself is undone by the theft of a firearm, and by the courts refusing to enforce firearm-related restrictions against those that violate them.

    I like it. I might change a few little things like keep registry information at the state level but all in all it is a plan that will save lives

    I like the fact that you have given this some thought.

    But.... I disagree with you. There are no additional gun control laws needed beyond what is already in existence and some of those need to be repealed.

    Contrary to popular belief among the un-gun folks there is no such thing as a "gun show loophole". Any licensed firearms dealer (FFL) selling at any gun show in the U.S. must conduct a background check just as they would if making the sale at their shop. Private sellers at gun shows must comply with the laws of the state in which they are selling. If that state requires a background check on all firearms sales then legally it must be done. On the other hand if the state where the private sale is being conducted at a gun show has no background check requirement then obviously it doesn't have to be done. A gun show sale in that situation would be like any other private gun sale in that state between two private individuals.

    I don't quite follow your ideas in section 2; it seems contradictory. You say establish a Federal Gun Registry but then indicate "unlicensed gun sales" under some states' law.

    In section 3 you want to require dealers to track their inventory. I am not a gun dealer but I would believe they already keep very close track of their guns.

    It is already illegal for the people mentioned in section 4 to purchase guns. This section is the only part of your proposal that I am somewhat in agreement with. You are correct; people who are known to be violent, have mental issues or are under restraining order should not be allowed guns. And this is already the law. I would add to that felons and minors.

    There is no need for gun control other than preventing those mentioned in the above paragraph from having guns.

    We really don't need to save lives. The world is overpopulated now. Let's just start calling it a from of passive eugenics.

    UBC is basic common sense.

    no one should sell a gun to someone they dont know without making sure that person isn't a criminal.

    its stupid because criminals rarely get guns from people who don't know they are criminals. its a waste of time and a scheme to harass honest gun owners.

    And lets make sure no one sells alcohol to anyone before making sure they are not an alcoholic.

    Your concept doesn't really make sense, "common" or otherwise. It indicates that it is my responsibility to make sure that some criminal out walking the streets is kept from buying a gun. Why don't the legislative system, judicial system, prison system and the law enforcement community make sure there are not criminals on the streets?

    I sold a used car to a guy a few months ago. I didn't check to see if he had a drivers license or had previously used a vehicle to commit a crime.

    Then give those sellers direct access to NICS.

    BTW the Colorado UBC requires background checks for sales not just to unknown buyers, but to the police, CCW holders and family members including spouses and siblings. We don't trust Democrats to write common sense laws.

    they seem to think that the only crime that should restrict honest people is that Malum prohibitum crime of a criminal owning a gun-and that of course is already illegal so they want to engage in a form of prior restraint. why do they do that? because their real goal is to harass honest gun owners.

    I as a gun owner could NEVER, ever, sell a gun to someone without first making sure they are not a criminal and have no outstanding warrants for arrest.

    I could not live with myself as a human being, or consider myself a patriotic American, if I sold a gun to someone who turned out to be a wanted man.

    But that's just me.

    well good for you. I don't sell or give guns to people unless they are family, or people I know have CCWs or I have personally seen pass a background check. But the fact is, UBGCs are worthless in preventing criminals from getting guns. Its just another hassle anti gun activists want to foist on gun owners. They don't care if it costs gun owners time and money. its all about harassing them

    the purpose of UBC is to prevent criminals and folks with outstanding warrants from being able to get a gun illegally.

    so you're happy with the idea of selling a gun to a murderer or child abuser who is on the run?

    I guess we view patriotism differently.

    I think its unpatriotic to possibly sell a gun to a criminal on the run from the police.

    some people realize that your schemes are designed to pretend they do something about crime but are really designed to harass gun owners and make the rest of the USA subject to the same silly laws that NYC gun banning politicians try to foist on their subjects

    That may be the purpose, but not the effect. Criminals will continue to use straw purchases, FFL diversions, illegal street sales and theft to acquire guns. UBCs affect none of these.
