The law is concerned with who the aggressor is. IMHO, if you are sitting there minding your own business eating a meal, and someone approaches you belligerently and violates your space by fouling your food, that makes them the aggressor. I think the overwhelming majority of cops and judges would agree. But fact is in our country, such a thing would largely be a function of the judgement of the officer who arrives on scene. One officer may show up and say "guy deserved to get punched" while another officer may show up and say you were the aggressor in that situation and book you.

You also have to employ a reasonable response. Even if the guy who put his finger in your food is the aggressor who deserved to get punched, that doesn't mean you can pull a gun out of your pocket and shoot them dead right then and there on the spot.
