California man detained, given citation for eating sandwich on BART train platform

    A California man was detained by transit police for eating a breakfast sandwich on a train platform last week — a violation of state law that ended with the man being handcuffed and given a citation.

    Steve Foster, 31, was on a Bay Area Rapid Transit platform near Contra Costa Center, heading to work around 8 a.m. on Nov. 4, when the transit officer, identified as D. McCormick in videos posted online, stopped him, telling him he wss breaking the law.

    Alicia Trost, communications director for BART, told Fox News on Monday the California law in question is PC 640 (b) (1): "Eating or drinking in or on a system facility or vehicle in areas where those activities are prohibited by that system."

    She said Foster was not arrested following the incident but was issued a citation for "eating inside our paid area which is a violation of state law." Trost said Foster was "lawfully handcuffed when he refused to provide his identification."

    BART's general manager, Bob Powers, said in a statement on Monday that there are "multiple signs inside every station" indicating that eating is banned from paid areas. Powers said McCormick was on another call when he asked Foster to stop eating. When he passed by again and still saw Foster eating, the confrontation ensued.




    Utter insanity imo.. You can **** on the streets or **** up or live anywhere you want but you cant eat right where they have food vendors?

    Badly written law or just utter stupidity? Thoughts?

    I remember a story about signs being put up stating that bathrooms were for customers only....man, what a mess that created.

    Now continue to tell us all how Trump is taking away our freedoms. Heck, I'll even go as far as saying uber liberal California takes away, restricts, prohibits, bans, regulates and outlaws many of the things we once considered part of our freedoms.

    Edit; BTW, in CA it's not the republicans who can't read. You should probably ask yourself why CA wants to ban exit exams.

    There was no mention of the offenders party in the article, but it is refreshing to hear those claiming to care about the less educated reveal their contempt for them. At least you're being honest.

    I live in CA and have used our transit system for years before I could afford a car. There is no eating or drinking allowed because people are slobs and leave a mess. That mess, combined with the messes of other passengers creates a hazard. For some reason, people in CA love to sue (I call them sue-ers) so allowing people to create slip-and-fall hazards is not a good idea here in sue-happy CA.

    At least you got a cheap shot in!

    I have no doubt there are all sorts of ridiculous laws, and especially more so in California, but I actually don't have a problem with this.

    It was against the law, he didn't have ID, so what do you expect them to do?

    The only caveat is, if I made the rules, I might have made an alternative option where the offender can pay a fine in cash, on the spot, if he has the cash, without needing to show ID. They have very tiny portable card machines now too that fit into a mobile phone and can charge a credit card. I'd make that an alternative option for civil liberties reasons, in the case of small fines.

    However, one could argue ID is still important to be able to identify repeat offenders.

    It's very reasonable to ban eating in certain areas.

    And yes, it is very ironic that these cities have made it legal to poop on the sidewalks but you can't eat in certain areas.

    Probably neither.... without even clicking your link, let's play a game called 'Why did this guy get a citation instead of a simple warning'

    A - This happened in California
    B - This law is unclear or poorly posted
    C - He ignored the first warning and continued eating, then refused to provide ID during the 2nd encounter
    D - The food vendors are ON the train platform (instead of likely NEAR the train platform)
    E - His political affiliation

    This guy did violate the law but it's sad that police have nothing better do like citing fare evaders and disrupters on the train.

    So you admire therooster to the point of wanting to emulate him? I am not a fan of excessive laws. I would rather see people take responsibility for slipping on a sandwich they didn't see because they were walking and texting, but since we reward them with large settlements, it is necessary to enforce laws. The signs use images instead of words, so both parties can understand them!
