Did you also note that for the law that she's being charged with that the weapon had to be operable at the time of the incident? It clearly wasn't if they had to disassemble and reassemble it to get it to work. You do not need a jury to know whether X law applies to a situation or not. A DA chooses the charges. Not a jury. A jury decides on the charges presented to it. And last I knew evidence is to be presented exactly how it was retrieved. Changing it and then presenting it is not allowed. As for your scenario, 1: you'd have to prove that they flipped the spring after the fact, something the prosecutor can't prove one way or another but the McClowskies can prove was done prior to the event. 2: you'd also have to explain why they didn't do the same for the other gun, ya know, being skilled litigators and already knew how to do such.
