And yet, abortions WERE legal in this country for the first 100 years of it's existence - obviously the Founding
    Fathers would disagree with you.

The right to one's body includes everything within it. In the case of a woman it is the totality of her life. Once the fetus is no longer part of her body it has inherent rights of its own independently, not before. No one has the right to determine what a woman can or cannot do with her body. That is a violation of HER bodily autonomy.

First, being legal =/= being a Right.

Second, it was left up to the States in those 100 years. Some states it was legal, others it was illegal.

Third, I quoted from one of the Founding Fathers a few posts prior to the post you quoted. James Wilson. A signatory to the Declaration of Independence, US Constitution, and one of the first SCOTUS Justices. Post 71 if you're interested. He didn't disagree with me.

    The fetus isn't her body.

Because its an extreme situation. Quite possibly the most extreme situation anyone will find themselves in. Its more life altering then a person literally breaking into your house, and robbing you...Which is grounds to terminate their life.
And it is exactly what an uninvited fetus is doing.
Sex does not always end in pregnancy, so when it is not intended, a woman should have the right to decide her fate. Would you disarm a woman who was being robbed? Good neither would I.

A person can have a right to life and abortion, in the same manner you can be a pro life mother, and still be for the death penalty.
Its self defense in the case of a mother who requires an abortion to lead a life.

Thanks for giving an example of taking it to the extreme.

My comments were based on this:
    https://www.houstonpublicmedia.org/...-ban-does-and-what-it-means-for-other-states/

Is that information incorrect? It would seem to me that giving someone a ride to another state or providing them bus fare would make one eligible for the laws sanctions.

    What do you think?

A GOOD QUESTION, TO WHICH WE ALL KNOW THE ANSWER:

This constant double standard is a violation of our rights to equal treatment under the law.

The Constitution was written in plain English, it doesn't need "interpretation", certainly not to the extent that interpretation means perverting its plain meaning. SCOTUS's power is clearly stated in Article III, it doesn't need interpretation and certainly not to the level where SCOTUS has a eureka moment in Marbury v Madison where they all of a sudden saw the light and decided hidden in the wording in Article III is the power to interpret the Constitution. If the founders believed that was the case, they would have clearly stated that in English.

100% wrong, it's a blatant conflict of interest. See my employee contract analogy.

Of course not, they just like you have been thoroughly indoctrinated into believing SCOTUS has the power to interpret the Constitution because SCOTUS said so and even makes that claim on their website. My solution is not perfect and I'm sure some experts can come up with a better solution but no solution will ever be implemented because SCOTUS will prevent any potential solution via, what else? "Interpretation". See #3:

That's silly. The fetus does not exist without her body.

You and I can't survive without air. Yet the air is not ours to do with as we please.

Also quite silly. That's not an analogy, air is not biological, never mind a living entity. It's also not a biological creation and has no inherent rights. Furthermore, gas station owners would dispute that since they charge for air to inflate tires, so they can make the claim it's their property to do with as they please lol.

Where do you think air comes from? Space?

Never aired up your tire at a gas station? There are no oxygen bottles next to the tire pump you know. IE: they're not charging you for the air, but the use of the machine.

What are you talking about? Sorry but your "analogy" is off in lalaland. It has nothing to do with inherent rights.

quote: reserves this right to the states and to the people. amendment 14's equal protection clause leaves it up to the people. the 14th amendment? says (nothing) about abortion! that amendment is on citizenship rights. not abortion.

quote: just moves the culture war from washington to sacramento. doctors will continue to be shot and clinics will continue to be bombed for the "right to life." "
washington to sacramento? i think not!!!! it moves the question to (all) states. not just California. abortion will not be banned in the u.s.! it will be moved to each state to determan if it will have abortions or not.---- doctors will continue to be shot and clinics will continue to be bombed really? i've not heard of any doctor or clinic being shot or bombed in quite a long while. please show me your recent shooting or bombing, to back up your statement.

quote: you sure the leak came from a staffer? you would fi8re the liberal staffers because 1 "conservative" did not follow the rules? (if) you had read and understood my statement on this. i said----(all) clerks or staff. not just liberal or just conservative. please read more carefully in the future. with all gone they got the leaker.

quote: sounds like that "mob rule" that the founders feared! the only mobs threatening the court are the liberal --pro-abortion mobs outside the supreme court, and around the nation who don't like this----"possible"---ruling. please get some real facts before posting. thank you. :)

uninformed. all news outlets agree the choice of wither a state will allow abortions or not. will be left up to each state. there will not be a nation wide ban on abortions. please read up on this before posting. :roflol:

quote: The fundamental question is whether conservatives like you are willing to pay the political price of a reversal of Roe vs. Wade. i think the gop is in a great position right now. and (if) the leak is correct on the supreme court ruling. i think we will be in a much better position come the mid-terms. since the states will have the choice on weither to allow abortions in their state or not. great place to be, i think. :)

quote: ]You are 100% correct. The founders made that quite clear in our founding document, the Declaration of Independence. You should read it sometime, it might enlighten you. That said, the Bill of Rights protects ALL rights. They are protected from being violated by government and others.Rights are inherent at birth, they cannot be granted there you are wrong. artical 1 section 9 puts limits on congress. ie rules. artical 1 section 10 gives only limtied powers to the states. again rules.artical 111 section 1 gives limited powers to the supreme court. amendment1 gives the (right of freedom of speech/religion/press/expression to all citizens. i could go on & on, but you get the picture. the constitution codifies our rights in the supreme law of the nation. you see i have a copy of the constitution with my computer, just incase some one like you tries to make silly statements on it. i can check it out for the real facts.

quote:The founders made that quite clear in our founding document, the Declaration of Independence. You should read it sometime, it might enlighten you. That said, the Bill of Rights protects ALL rights. They are protected from being violated by government and others. and the bill of rights is part of the constitution, which destroys your statement above. quote: In fact there's nothing in the Constitution that gives anyone any rights whatsoever then you say the quote: the Bill of Rights protects ALL rights. but the constitution limits the rights to the government & people in law. like you can't shout --fire!!--in a theater, but you can speak your own thoughts anywhere, weather others agree or not. i would call that----(double talking) saying one thing then doing a 180 in the next sentence

Another leak: Roberts trying to save Roe while sacrificing Casey?

Or, CNN is lying. Who knows.
If that's Robert's decision, I doubt anyone will join him. If the 3 Lefties would compromise, Roberts could probably pick up Kavanaugh and a 5/4 decision to save Roe and dump Casey, but the 3 Lefties are unlikely to budge an inch, they are Abortion Absolutists, and as such, will want nothing on their records agreeing to any restrictions to abortion.

    A 5-3-1 decision wouldn't surprise me.

Sounds like hyperbole to me. On what do you base this idea that leaving it up to the states means abortions will be banned across your country?

You also have Canada nearby, where abortion is legal.

It is hyperbole. The Left is facing a disaster in Nov and they are hoping that this will galvanize them, so they are making-believe that overturning Casey and Roe = nationwide ban, it does not.

It simply means that any bans, when evaluated by the Court will be evaluated on a rational basis to determine if the ban is reasonably related to a legitimate State Interest. It's a standard commonly used for issues not specifically covered in the Constitution. A ban on something specifically covered in the constitution, like freedom to keep and carry arms are looked at much harder, with a less differential view of the actions of the State Legislature than Rational Basis standard uses, but, the state still must show a rational basis for their actions.

I'm going to wait until they actually release their decision. Getting all worked up over a 3 month old first draft, when they are probably on the 7th draft at this point, seems silly, but, the Left is desperate for energy so I can't really blame them for grasping at straws.

So they're gonna do what? Vote a Supreme Court Justice out of Office? That's not how things work.

One thing I will say is that, while my personal belief is that abortion should be legal to a certain point (that I'll let people smarter than me in fetal development argue about), the Roe court did really have to tie themselves into a pretzel to find it in the Constitution. Interracial marriage, same-sex marriage, those are slam dunks if you read and fully comprehend the 14A, abortion not so much.

But I'm also going to wait for the ACTUAL ruling to come out before I worry or think about it too much. And even then it won't be all that much, as it's one of those "meh" issues for me that I wish would just go away one way or the other.

It means that women have to stop voting in Republicans. Or y'all can be satisfied being barefoot and pregnant; up to you.
