If you're too lazy to look up "Department of the Navy versus Egan" then I'll be too lazy to give you any reply other than the suggestion that you pore over it before posting anything else about this drama of 'Trump and the documents'!

    Here's a hint, courtesy of @Condor060 :

I do know you well. :)
I did my best to help and explain how you move away from a discussion that goes south. I've never known you to be angry. You simply know when to fold them when a discussion is deteriorating.

That I disagree with. The fact that this search warrant was signed off by Garland himself, taking full responsibility, means this wasn't some screw up; this was well thought out and intentional. So I think they had already decided to indict long before the search warrant was drawn up.

Seriously... seriously, do you have any idea how ridiculous you make yourself sound?

I'm not trying to "distract people" at all, and I've already said about two hundred times that if Trump is legitimately suspected of having committed specific crimes, he should be officially charged and made to stand trial in a court of law. What the hell else does the Loonie-tunes Left want? Obviously, as you stated, their reply is, "Go to jail. Go directly to jail. Do not pass Go. Do not collect 2 billion dollars from the Russians." :psychoitc:. :roflol:

There were two impeachment trials that were "well thought out". They failed.

It's not an unfettered, and even a President is required to follow statutory processes to do so. The reason is obviously national security. Moreover, he simply didn't do that. Where's the memorial where he did that? Finally, for the sake of argument only, how would any of this entitle him to steal the documents?

Your specious attacks on me refute nothing and are bordering on a rules violation. Get back on the subject and address what I post.

The liberal democrats probably destroyed that one too. I think right after they tore down Lee's. ;)

I don't think Garland wanted to sign off on the warrant. He was strongly nudged to sign off on it as a favor to those who gave him a second chance as AG, by those who have always been out to get Trump.

You could very well be correct though but I will stand by what I wrote because the optics look like a planting of documents since no one was there in the house to see what they were up to.

In the first place, I do not make common cause with anyone, right or left, who allows his political prejudice to convict a person based on emotion and initial news reports, especially since the sources are themselves biased.

Second, I never said a word about the judge or the FBI being guilty of anything.

Third, I cited the statute above, and it is obvious to anyone but Business Insider and MSNBC that you can't convict Trump based on the presence of the documents at Mar A Lago standing alone. There are several elements to the offense, physical possession being only one. If you really think Trump had personal knowledge of the contents of those boxes, then you give him more credit than I do.

We need an indictment and a trial and a conviction by proof beyond reasonable doubt, by a unanimous jury and an appeal (possibly two) before you lock him up.

Otherwise, Trump is not the fascist here.

I think it was obvious a typo.

Now do you have anything to add to the discussion on the issue at hand?

Right but they don't have to worry about any Republican senators in a DC Jury pool.

Very well said. Some have bought and have been holding onto Trump's noose for how many years now?

I'm not sure Trump can't get venue changed to Florida. That's where the documents were found.

Yes they do, it is a constitutional authority and already ruled on by SCOTUS

"The majority ruling in the 1988 Supreme Court case Department of Navy vs. Egan -- which addressed the legal recourse of a Navy employee who had been denied a security clearance -- addresses this line of authority.

"The President, after all, is the ‘Commander in Chief of the Army and Navy of the United States’" according to Article II of the Constitution, the court’s majority wrote. "His authority to classify and control access to information bearing on national security ... flows primarily from this constitutional investment of power in the President, and exists quite apart from any explicit congressional grant."

Steven Aftergood, director of the Federation of American Scientists Project on Government Secrecy, said that such authority gives the president the authority to "classify and declassify at will."

In fact, Robert F. Turner, associate director of the University of Virginia's Center for National Security Law, said that "if Congress were to enact a statute seeking to limit the president’s authority to classify or declassify national security information, or to prohibit him from sharing certain kinds of information with Russia, it would raise serious separation of powers constitutional issues.""

The motivations for Garland to sign the search warrant's are suspect, but we do know he did sign it and took responsibility for it. For the administration's constituency (hint: not you or me) the optics are pretty good.

Yes! And, in neither one of those two impeachment trials was there any enumeration of specific CRIMES! But, after all, Democrats had already grown used to the practice of using innuendo, hearsay, rumor, fiction, and other bullshit instead of an actual, factual listing of crimes -- "Russia, Russia, Russia" comes immediately to mind....

But, hey, it was all good enough for radical Democrats, and when they have the POWER to act however they want, they do!

Well, in their defense, Schiff never did release that conclusive proof he had that Trump was guilty of collusion with the Russians. Without it they didn't have a chance. ;)
