    I do find it funny tho, all the contortions that the right is now making to try to support their position that Trump cant be taken off the ballot. They are becoming anti-constitution to support the orange guy, and then becoming anti-states rights for Colorado to be able to make their own decisions.

    This WILL go to the US Supreme Court, and I think it will be expedited. But I also think that the issue that will go before the US SC will not be Trump being put back on the ballot, it will be Colorado’s right as a state to remove a candidate from their ballot. Either way, the right in this country will have to admit that they are willing to either deny the constitutional “states rights”, or they will have to deny the right in the constitution to deny a candidate for “insurrection”. Its a loose loose for the right and their perl clutching “DA CONSTITUTION’ because one way or the other, they have to be willing to claim the constitution flawed or wrong to support the orange guy

    Get the popcorn ready, because the hypocrisy has to come out, one way or the other !

    I think SCOTUS has to look at a very narrow issue IMO. Not so much what is insurrection in/of the United States BUT what is insurrection of The Constitution of the United States. Oaths were sworn....

    So you think Democrats should make that decision now as to who and who isn't constitutionally eligible?
    Are you not taking a look at how this door swings both ways?
    Hows it going to work for ya when red states decide Biden can't be on the ballot because of his dementia and use the 25th amendment to remove him. Or did you think this through that far yet?

    Which I still say is the silliest part of Section 3. Why should it matter that you previously swore an oath?? If you are judged to have engaged in insurrection, you should be disqualified period...

    The oath part might be because you might have run for office before or were in the military, but again, who cares?

    Insurrection = Disqualification.

    The Constitution decides that, and the courts interpret the constitition.

    Are you saying the 25th Amendment is unconstitutional? Weird. I never thought of the Constitution as being unconstitutional. You guys are so creative!

    I think it's a bad legal argument, but then so is the case for removing Trump from the ballot in Colorado. But if you guys are going to engage in full on lawfare to destroy the integrity of the election system...

    Fully agree but I think that the defense are going to go for the "degrees of" insurrection. RW media are already laying down cover that it must be almost a war footing to constitute insurrection. SCOTUS' job is to look at it from strictly a Constitutional perspective IMO.

    Now THAT is creative.... Almost like the guy who earlier said Trump objected to certain states being certified during 1/6 certifcation

    Or the guy who states Trump was found not guilty of insurrection.

    The 25th doesn't leave it up to the States.

    1. "Democrats" aren't deciding this. Unless you think the CO state supreme court consists of all democrats and they're being instructed on what to do here; and
    2. States don't decide to apply the 25th Amendment.

    Yes, but it certainly adds gravity to the seriousness of taking an oath of office, and highlights the despicable nature of using an official office to harm the Country and it's Constitution that you swore to uphold and defend ... as tRaitor tRump most certainly did.
