Road rage results in gun shots/arrest...

    The husband walked up and punched the dude in the face, not exactly self defense if he walked up and took the first swing. it still would not of been legal.

    Him following the person who cut him off escalated the incident and for self defense that would not of been eligible.

    I agree that he should not have followed them.
    But we have no proof that he actually hit anyone, vid is not conclusive.
    But if he did hit anyone, that would have been the driver and the driver only.
    The passenger had no business getting out and laying a hand on him.
    I personally call all involved a bunch of dumbasses that need an asswhoopin.

    The moron was on thier property after following them, he assaults the driver and gets his arse beat then his wife gives him a gun and he fires it. The moron and his wife were in the wrong and both should do some time to learn a lesson. If he had followed me and attacked me on my own property they would have zipped him up in a bag, here in Texas many of us do carry and take a dim view of people attacking us on our own property, or anywhere else for that matter. Hope they both get plenty of time to cool off, idiots like them are the ones that runin it for everyone else that does it the right way.

    We also now have a law in Tx, That says even without a concealed carry permit (CCW) We can carry in our vehicle, loaded.

    Now if im riding with a buddy and some dink walks up and punches him there is no way I am going to sit and wait for the guy to do it again. I will jump off the truck and confront the guy also.

    And you may very well end up in jail for battery.
    I also tend to shy away from friends that need me for protection.
    We can also carry with no permit in the car and on my property, he would be looking at a J frame SW as soon as he started stomping over to my truck.
    I have no problem with him being in trouble, but my contention is by law the passenger had no reason to beat on him as well.
    Its another dumb and dumber move on all involved.
    Someone cuts you off, let them go. Start esccelating it into a gun fight and you are screwed.

    Which is why I am wondering why your original post of the wife putting a bullet into each persons head was even appropriate since He escalated it by following and proceeding to go onto their property, exiting the vehicle and the possible punch. I feel threatened on my property and you see the barrel of my 1911 .45 and an extra mag in my other hand.

    Well no what ifs here, I really dont care if you would have shot him or not.
    I think its safe to say many of us would as soon as we saw him get handed a gun.
    But his beef was with the driver, but the driver AND passenger jumped him. You cant go farther than force on force. And in this case one on one would have been force for force.
    But when the passenger jumped in it was two on one and that is not right.
    She would have been justified in doing just what I said and letting the chips fall where they may.

    They were wrong, not criminal, for following them. It was criminal for the passenger to get out and start beating on the guy.
    Right then if they wife got out of her side of the car, walked around and saw TWO men beating her husband into the ground. Then yes, she should have shot them.
    Or at least could have and had a decent chance of walking away from it.

    Why is it not right? If someone punched your buddy you would just sit there because "force for force"? What if your wife was attacked? The passenger had just as much reason to act as the driver.

    What reason? Someone hits your buddy, its your buddy's job to defend himself.
    Its not like he was knocked out, the driver got out of the truck pretty quick and reacted.
    Not if the driver had been incapacitated, and the other guy continued the attack, then yes by all means protect your friend.
    Or if they get out and get to swinging and its clear your buddy has no chance and its not going to be a fair fight, due to size or otherwise.
    Then protect your buddy.
    Now lay a hand on or even try to lay a hand on my wife or any female family member in my presence, well you may wish to bring your own clean body bag.
    But we are not talking about him hitting a woman, he allegedly hit a man.

    I know what you mean but generally the law doesn't like to make those distinctions because it causes problems with consistency. I'm curious how the law actually applies in this case but I doubt it would be written in such a way that says "If you are a man fight you're own battles, and if you're a women its OK to have help". I would be shocked if the passenger gets in any kind of trouble here, but who knows.

    Thanks for the reply, but I am still confused. Here is the deal, the guys did something the couple did not like, they followed them to their home and the guy gets out and walks up onto their property ad assaults the driver. The other guy got out and help beat him off, there ar some places it is the law for you to help someone being attacked if you can and any good friend would do the same. The guy walked back to his vehicle and instead of leaving or calling police his wife hands him a gun, and then he goes back up and starts taking shots to show of his power, also illegal. I carry and had he walked back after I smacked him around he would have been shot DEAD, if I had felt a threat when he first walked up and started assaulting me I would have shot him and guess what the law would be on my side. The couple is in the wrong on all counts, he was pissed and made a mistake, he paid a price (a few punches) and then took it to another level, it is a good thing no one died, had the cops been there it might have been the guy with the gun. He needs anger management classes at the very least and probably a little jail time, her I will leave to the courts. He sure as heck should lose his carry permit even if charges are not persued his actions prove he is a loose cannon that should not be carrying. Look, I am all for people being able to carry and protect themselves, but the idiot and his wife are not good examples of good ownership or carry and harm the movement to defend the 2nd A..

    After its all said and done, he probably wont because the other driver was "more wrong" by advancing with the gun drawn after the beating was over and nothing really buy his pride was hurt.
    But yes, I know in Florida, a much larger person can have deadly forced applied even if they are unarmed but clearly capable of injuring or killing another person. Man on woman, huge 300lbs man vs a 150 lb man, younger man against a elderly person.
    Even a female police officer can kill a man vs having to engage him in hand to hand combat.

    I still have an issue with your thoughts on the matter, somehow I think you might think different had you been there, but you are on the right track.
    Do you think the couple should be charged?
    Did they have a child with them, I heard this, and if wrong that is aother issue, anyone know?

    Here is the deal, we dont know what transpired on the road.
    We also dont know that the driver knew he was on the teen drivers property.
    I know that if Iam being followed, home is the last place Iam going to let someone follow me.
    We also are not 100% sure the driver was struck, the dope may have swung and missed or hit the seat. Its not clear.
    We do know that he did something and from what I can see turn and walk away, stupid, if you are going to start swinging. Keep swinging.
    We saw the driver jump out seemingly un affected by whatever contact and was able to make hay on the dude on his own, but the passenger starting getting plenty physical too boot.
    Passenger in my view is clearly out of place and wrong.
    Stop right there.
    IF little john wayne had just got into his car and called 911, he may have had a case to have them arrested. How it would work out after the vid was viewed is hard to say.
    But he put it all in his court when he took that gun from his old lady and pointed at the other guys as they were getting back in the truck to leave. They were pretty much scared off from the beating by the wife with the gun, even though it looked like she had no idea what the (*)(*)(*)(*) she was doing with it.
    And I agree, he does not have the temperment to fully understand what concealed carry is all about.
    You dont let stupid traffic deals turn into gun fights.
    IF he did he would have taken the gun from his wife and got in the car and left or called 911. His permit should be toast.
    His only hope in this deal is the judge cops or whomever sees that the incident escallated with the passenger getting out and leading to a more sever beating.
    Honestly, he deserved his little ass beat. Not for pulling the gun only,but for the whole deal. He is a grown man argueing with teenagers.
    How pathetic is that.

    I'm glad you mentioned that Casper. When I first read of this story (and started the thread), I swear I remember reading that the couple has a child with them (a daughter I believe), but when I tried to find the article again, I could not.

    I was hoping to find it, to point out how much more in the wrong this jackass was. If he in fact did this crap in front of his kid, he should face some type of child endangerment charge. Not to mention the emotional damage his action may have caused his child.

    What a jerk!

    It would not surprise me. I had a (*)(*)(*)(*)(*)(*) get out at an intersection and start giving me hell thinking I was tailgating him.
    Said my Suburban on 44s was scaring his little daughter. I looked at the car and she was in a car seat, so I have no idea how she could see me.
    I was just going with traffic at about 25mph like everyone on busy road.
    Anyway, I just asked him how scared would she be if I blew his brains out right in front of her?
    I mean, that stuff happens.
    And he didnt get out and ask me to back off, he was "telling" me to.
    People like that are just asking to get killed or have the crap beat out of them. You dont do that in traffic. You dont start fights and arguements over precieved traffic unkindness.
    Little John Wayne was very lucky that them two boys were not packing heat and got back out when he approached with the heater, because getting killed over a traffic thing is pretty stupid reason for your wife to have to fill out your insurance policy for.

    I am a little on the fence about the force to force, If you are getting attacked and the attacker has a knife and you pull your gun is that not excessive force?

    Of course a one on one fight with one guy jumping you from behind puts you at one hell of a disadvantage. I just read all the post's and this actually worrys me a bit.

    This could have gotten you time seeing a police officer, this was stupid to say to someone yelling at you and had that person had a firearm and you said something like that, he might of shot you.

    In the OP's post, The one in the wrong was the guy following. Maybe he was older and the guy getting out of the drivers seat was 16 just getting his license, Would a grown man hitting a kid be acceptable?

    Stupid people do stupid things, Prepare for the worst and hope for the best.

    I still do not understand why SHE was arrested. What did SHE do? Looked to me like she armed herself while her husband was getting his ass handed to him, and came over after and handed him the weapon.

    I just do not see the charge there...

    I'm not a lawyer or cop but I like to think I at least know right from wrong. Could handing a firearm to a person that subsequently uses it illegally be unlawful?
    I'd call it aiding and abetting felonious conduct.
    Of course the problem would be proving she knew he would use it illegally.
    Just a random thought.
