It's not too often that I get to blog about this issue since I work for a property management website. However, I recently wrote about whether landlords can limit or ban firearms on their rental properties. I think lots of landlords and rental owners are concerned about guns on their rental properties, but they don't think they can prohibit them because they don't understand that the second amendment is a limitation on government, and not on private citizens. This short article tries to clear that up. Gun rights advocates aren't super happy about the answer. It's interesting when you have landlords' property rights competing with gun rights. Most comments I've received so far have been from gun rights advocates, but I have to think that some gun rights folks are also concerned about being told what they have to do with their property -- after all, if it is their property, shouldn't they get to decide if guns are allowed or not? Here's a link to the article - it's short, I promise! I thought you might be interested in a blog piece I just wrote. http://www.allpropertymanagement.co...-tenants-second-amendment-right-to-bear-arms/
Iam renting now. No issues. Gun safe is not in "plain site" but not hidden either. Then there is the NRA sticker on the truck and the window next to the front door. But the home owner is ex Naval Officer and this is the south.
I would avoid putting too much stock on Brady Bunch stats. Anyway, some thoughts on keeping you tenants and property assest safe: Background checks on prospective tentants a must. Avoid renting to people with large gang tattoos, especially across their head or face. And require that all people living in your complex have a photo and fingerprint done. This includes all boy/girl friends relatives and children hanging out there.
"A gun in the home is 22 times more likely to be used to kill or injure someone in a domestic murder, suicide, or accident than to be used in self-defense. (From the Brady Campaign to Prevent Gun Violence.)" Glad they cited the Brady Campaign for that statistic or I might have actually taken it seriously.
Landlords have that right. They are stupid to do so, because they will be denying apartments to generally good honest citizens. Do you think that criminals will pay attention to a no-guns clause in a contract?
When I had a rental a credit check, background check and a income verification solved most of my problems when it came to keeping the deadbeats and criminals out. Guns never entered the equation. But a person is allowed to not to rent to gun owners, it is their right and should be respected.
This. And Brady statistics? Seriously? You might want to find a more objective source for writing your blogs. It might actually make you look credible.
What in the world are you talking about? All I said is that landlords have the right to not allow guns in their apartments. My other point is that if a landlord chooses to not allow gun owners to rent, then they are missing out on good law-abiding citizens. The criminals will go ahead and bring their guns to the apartments anyway.
Let's see, you "Might" write it into the lease agreement but if were me you would be setting with a lot of apartments empty because I would never rent one from you. That's MY right!!!
Ayuh,... I have rentals, 'n really don't care how big of a Gun Collection any of my tenants have,... Matter of fact, I've increased my collection by tradin' guns for past due amounts,...
Property rights trump almost all other rights. That being said, I don't care if my tenants possess firearms.
