The double jeopardy argument will fail because it isn't appropriate. If Italy asks for extradition and the US - which asks for more extraditions from other countries than any other jurisdiction - will have a problem.
I would agree with that somewhat. I have been to Italy twice, and the men there take sexism to another level. Its ingrained in the culture. Pinching asses of random women in public and borderline assault on them is not an uncommon sight in most of the cities.

She is Guilty. period. Don't count on that, we have agreements and if we want them to return American criminals in Italy to the US we have to do the same in return. It is not that simple.
The Italian appeal system doesn't end at the appeal. There's a judicial review of the process, which was found to be flawed, therefore the original finding stands. No double jeopardy. The final final supreme court decision will be handed down in spring next year.
I would hope not. Her "conviction" violates our Constitutional prohibition against Double Jeopardy. Even if she is guilty (and I have not followed the case closely enough to have ANY opinion on that point), it's better that she be set free than violate the principal.

But there are a lot of differences between the human races.........some are more prone to violence as evidenced by the prison population relative to percentage of population........once again that reality equation
It is quite unimportant what the Italian system is like in this regard. Under the American system of justice, this would amount to double jeapordy. And that is all that really matters, for the purpose of establishing this exception to the mutual-extradition treaty.
She was acquitted in an Italian court, which was why she was returned to the United States. Case closed. The fact that Italy reopened the case is irrelevant to her rights as an American citizen under the protection of the U.S. Constitution, which prohibits double jeopardy. If Italy wants her back, all the U.S. government has to do is say 'no'. What are the Italians going to do about it? They can't make us an offer that we can't refuse. This ain't some crappy dago movie.
American jurisprudence is not available to American citizens in foreign countries and it is severely limited in extradition treaties. That being said, the Italian government will not ask for extradition until all the judicial avenues are exhausted by both sides. In other words, until the Italian Supreme Court decides on the validity of the verdict, the verdict will not be enforced.. So, Amanda has about another year or two to worry. As for double jeapordy. I don't think so. The Appeals court found her innocent based on additional evidence that was exclduded from the original trial. The Supreme Court said that there has t obe a new trial because the Appeals Court did not consider all the facts. In other words, the Supreme Court voided both verdicts from the original and appeal trials in which a new trial was given. This is an exception to the double jeopardy rule under American law and it will not be used in any extradition hearing. However, because Amanda may be japordy because of the popularity of the crime, it is possible that any extradition will be denied on that basis alone and not double jeapordy.
this is total crazy, she was found not guilty, time for the prosecutor to admit he was wrong and move on, how long do they get to harass this poor girl
