Home owner kills intruder and found guilty despite Castle Doctrine !

    Or maybe someone thinking the owner has had a heart attack, fallen off a ladder etc. The door was OPEN, in many cultures that's an invitation to enter

    Most conservatives just salivate at the thought of killing somebody, it's disgusting and we need to stop letting them get away with it, but the gun manufacturers and the NRA push this culture of armed insanity and gun worship, where we all deal with everyone from behind a hair trigger

    how did you know he was a thief?

    maybe he was a lost kid.

    maybe he was a drunk stumbling around.

    "shoot first, ask questions later" is a very sadistic way to behave.

    If you're drunk, you still need to be held responsible for your actions.
    Does a drunk person who gets into rage and beats up a person not to be held responsible for their actions ?
    You enjoy giving excuses for bad behavior.
    At what point does the safety of the home owner and his family outweigh that of the thief ?

    it's his home and he chose to do with it what he did.
    the risk was taken by the thief who decided to enter it in the middle of the night.

    There's a lot of private property in this country. Are we talking only home or are we also talking detached garage, barn, outhouse and the south forty? I think common sense should tell you that you don't open up on a kid looking for his dog after the sun has gone down.

    I really hope that nobody is taking the legal advice being given here seriously.

    If you're not a lawyer but you want to discuss people's rights netiquette says you must put INALB, ("I'm not a lawyer, but...") There isn't anything that can happen to you anyway because these are (b) rules here. (only a fool would take anything from here seriously). Still, I truly expect some conservative will eventually say he did something because the Internet said it was legal..

    You can't tell me the average gun worshipper wouldn't kill somebody. Hell, they're anxious, all psyched up to kill somebody as soon as they buy it, IMO.

    Bingo, Channe! You're right on! Couldn't have said it better myself.... all of it.

    These people who condemn others for shooting an intruder instead of trying to detain him are living in LaLaLand...... it's so easy for them who've never experienced something like that to sit on the sidelines and criticize the victims of home invasions and tell them what they should have done instead or what they should do, if it happens. That's just laughable........

    One thing about an experience like that, as it was w/me when you're woken up out of a sound sleep is making yourself realize it's not a bad dream, but real and you're in danger....

    When my 2 girls were teenagers, I had them read the police report and talked to them about stalkers and always be aware of their surroundings... and told them that if something happens that they can't control, to do whatever they have to do to get themselves home safely.

    I like how you minimize burglary to "stepping on somebody else's property".

    Considering the two options, I think hunting criminals who trespass and burglarize, is the side I would like to be on.

    The person I was responding to talked about what he would do if he caught intruders in the house. He was discussing a hypothetical situation where the criminals had already dealt with getting into the house. I was discussing the situation he presented.

    Your closing the doors hint is so utterly absurd and meaningless in the context of the discussion I was having with him that I have to assume something is wrong with you.

    If it's true that he set up traps, lured in intruders, and bragged about wanting to kill some kids, than I'm glad he was found guilty. You don't just get to vent out your rage on random teenagers by luring them onto your property and shooting them just because your home was previously burglarized.

    So much for freedom of speech. I believe people should be able to say what they want without having to worry about winding up in a situation they could be arrested for it.
    I'm sure plenty of people have vented off frustration about wanting to kill kids that were no good.

    A defendant's words can certainly be taken into account, but I do not believe they should be used as de facto justification to arrest someone. (not unless it is a clear intimidating threat.)
    With the age of the internet, I'm sure they could troll through years of an individuals comments or emails, looking for anything to cherry-pick to make the defendant look guilty in front of a judge or jury.

    The article never said he was arrested because he bragged about wanting to kill some kids.

    Of course I think a life is more valuable than my friggen car and if you don`t then you`re lower than pond scum.
    That`s why people have car & house insurance...amazing concept to you I bet. And no, I`m not excusing the guy, he should be dealt with
    by the courts after the police are called and they arrest him. You know, the guys that are paid to carry guns & arrest people, not Bozos that have
    this `John Wayne`shoot em`up craziness...
    You arm chair warriors don`t stop & think what it is to take a life...you ever wonder why there`s so many soldiers coming back that are walking around with PTSD..it`s not cause they missed their mommies that`s for sure. So give your head a shake & think how you`d really feel taking the life of some 18 year old taking a dare and doing some college hi-jinks....

    But would he have been arrested if he had not said that? Would there even be enough reason to arrest him if he had not said that? That is the question.

    So it seems the defendant vented off frustration about wanting to kill some kids, had motion detectors because he was concerned about burglaries, and happened to leave his door open.
    Then he shot someone who was trespassing in his house.

    How is that enough reason to arrest him? :confusion:
    The police indeed should have done a thorough investigation to find any evidence that the shooting may not have been justified, but where's the real evidence?



    I do not think shooting someone on site just for trespassing in your house is okay, but how can we know what else may have happened? If the trespasser was threatening or refusing to leave.


    This was in Montana. How long do you think it takes the police to show up?
    There's a reason more people have guns in less populated areas.

    I don't know. I can only go on the details given in the article. It also said he lured intruders to his home. I'm not sure what that means. It doesn't explain how, but if that's true, couple it with the shooting, and I'd say it's enough to warrant an arrest whether or not he bragged about it.

    That is what is so difficult, without really knowing the details of the case, and hearing both sides, we cannot really know what happened.
    Whenever I read articles with vague descriptions of what happened I am skeptical. Detectives and prosecutors try all the time to "make their case" without much real regard for justice.

    He was burglarized before. Why would it be that profound that he added security to his home? And he spouted off about wanting to shoot the people that stole from him by entering his property illegally and taking his possessions?

    I just don't see the issue here.

    I think that would be a fringe element but a lot of worshippers say to themselves "just give me half and excuse and I'll blow yer ass off." Like the guy who shot the kid because his stereo was too loud.
