FACT: when a cop pulls you over for speeding, going through a red light, failure to use a turn signal, littering, not stopping at a Stop Sign, you have the Constitutional Right to say NOTHING.

the Supreme Court has upheld this.

You are Constitutionally protected against self-incrimination.

All you have to do, legally, is identify yourself and provide your drivers license and proof of insurance.

Other than this, you can legally keep your mouth shut and say nothing.

And you cannot be arrested, simply because you kept quiet. That's not reasonabloe suspicion or probable cause of criminal activity. Its just you knowing your rights.

Now, might you get arrested? Its possible. Cause many cops don't know the law.

Is it better to just answer all their questions? Maybe, but that's only if you have nothing to hide.

My advise: say as little as possible, keep your answers straight, short and to the point.

NEVER agree to let them search your car. If they had evidence of criminal activity, they won't ask you for permission.

Volunteer nothing. They have to prove you did something wrong, you don't have to prove your innocent.

true, but we really need cops to have cop cams or they can lie and say you gave them permission.... their word against yours

look how this cop lied and said he tried to deescalate the situation....

Based on videos I have seen on Cops, YouTube, the Bland incident, some folks cant do that.

Like the old Ron White bit on being Drunk in Public and going to jail. "I had the right to remain silent.........But......I did not have the ability"

I have been pulled over many times and I am always respectful and courteous and law enforcement appreciates that. I have never gotten a ticket either, even when I know I was at fault.

Sure you can sit there and be an ass, quoting the Constitution but that is just going to (*)(*)(*)(*) off the police who have many options to mess up your day. If you have nothing to hide then let them search, if you do have something to hide well you should be going to jail anyways.

Lol why worry about any of this if you've done nothing wrong? Are you high when you get pulled over? 90% of America does the right thing when they get pulled over. It's only the morons that don't follow the officer's orders that initiate the trouble.

Sandra's a bad example, as she was high on drugs. She had no idea what she said.

Have proof of that? She didn't break any laws, and the arrest was unlawful. You cannot arrest someone for a moving violation. If you're not arresting them, then they're free to go. It amazes me how big government republicans constantly talk about freedom and constitutional rights but are okay with giant military and police states, the biggest threat to your freedom. Police are trained to de-escalate situations, he escalated it because his ego was hurt.

Pull over to the closest safe place and put your hands on the steering wheel where the cop can see them. Let him come up first, and ask for proof of insurance before you start shuffling in the glove box to look for it.

My boss was caught speeding...actually racing... in his Porche...and when he was pulled over he immediately bent down looking for his insurance. The cop shouted at him to get out of the car and spread eagled him against his porche. Later when the cop realized he was just looking for his insurance, he told him that him bending over like he did made it look like he was trying to get a weapon from under the seat. And he told him its very important to keep the hands on the steering wheel until the cop approaches.

My boss took that advice and understood the reason why he was treated rough and was not insulted. He understood that the police have a dangerous job and they need to be on the defensive and prepared for trouble.

Be nice, be respectful and treat them like you would like to be treated. Pop off and run your dirty BS mouth and watch what happens.

more racism from the left. Thanks, at this point the left racism chant is silly bad joke that everyone is soooooooo sick of.
There are millions of black people who drive every day without being murdered by the police proving this has nothing to do with skin color and everything to do with how you were raised. Most of us were raised to respect the police and help them whenever possible. We are typically the ones that go on our merry way after being pulled over. The other ones in the same situation who were taught to fight the police either wind up in jail or dead.

Yes, you have the RIGHT to be an A$$ and (*)(*)(*)(*) the cop off and he has the right to screw with you right back, which normally leads to other citations or jail if you get really mouthy. If all you did was speed, why in the world would you purposely screw with the cop and escalate the situation? Its like sticking your arm in a lion cage, then wondering when it gets ripped off.

What did that woman do that was so egregious?
She was upset, yes, but it was the cop, not the woman, who escalated the situation.

For those with concealed carry permits in Ohio (and many other states), you are required to tell the officer that you are a permit holder, and weather or not you are possessing a weapon at the time. Failure to do so has repercussions including possibly losing your permit. So NO, that is NOT all you are legally required to say.

I have been stopped twice for equipment violations (burned out bulbs on the rear of two of my trucks), let them know I was carrying a loaded weapon in my waistband, and both officers thanked me and informed me of the burned out lamps then let me go. No ticket. No handcuffs, not dragged from the vehicle and beaten senseless. None of the things that happen to people who carry a chip on their shoulder and push the envelope of respect for their fellow man.

1st, half the country seems to automatically believe the cop lied whether he did or not and whether there is any evidence to support that view or not.
2nd, the worst thing you can do is go all jail house lawyer on the cop. Why? Because it makes you out to be a convicted felon and therefore automatically places in the mind of the cop the idea that there may be more going on here than a simple speeding ticket.
3rd however much out of character it may be for you be nice but don't suck up. It's the classic line from The Clint Eastwood movie Gran Torino, and it is oh so true. Half of life's problems will simply disappear if you are nice to people even when you don't have to be.

Excellent advice. I just add that simply remaining silent is not ''obstruction of justice'' [as police may threaten]. Obstruction of justice requires an affirmative act to destroy or conceal evidence or mislead police. Just keep your mouth shut. You can settle any dispute in court. If no body cam, you can always allege that the officer sexually harassed you, if you are fairly good looking enough to be believable, thus launching an internal affairs investigation -- just to make the officer's day.

They had dashcams and body mics already. A camera would help a bit, but not for what you're talking about.
