This is not a concern of mine; I don't think we need any bathroom legislation. But some people are concerned about adult men claiming to be transgender just to get into the same bathroom with little girls.

No doubt this does happen, although rarely.

Some claim that being gay or transgender is a mental illness vs. being born with it. The few gay and transgender people I have met, I would say it is a combination of being born with it and their raising/environment.

 

Knowing a kid is pulling something is different from being able to call him on it without it being a big pain in the ass, especially in the current climate. Consider the following reasonable way this could go down.

Teacher: Get out of the girls' locker room.

Kid: I am transgender, and I identify as a girl.

Teacher: You have a girlfriend.

Kid: I am a lesbian.

Teacher: Don't be silly. You are pulling a scam.

Kid: I have the right to identify as whatever gender I want. Don't discriminate against me, you transphobic, homophobic, CIS-gendered oppressor.

Teacher: You know that is not true. Go to the boys' locker room.

Principal: Go to the boys' locker room.

Local Newscaster: A teacher and administrator at Central High are forcing a lesbian to shower with boys...

We watched this crap happen in North Carolina. The headlines are designed to be sensational, and individuals who do not read the whole article jump to ridiculous conclusions. People who do not think critically will just follow along with media pot-stirring.

It is easier to take identity politics out of it by making anatomy, not identity, the differentiator.

 

Let's leave the federal government out of it and leave it to the states.

 

Agreed! From a logical point of view, it should be about matching the type of genitals to the equipment inside the room and what such equipment was designed for because improper usage could result in health hazards.

Example 1:
The "vaginas" that try to use the MEN's stand up urinals could possibly get urine all over the floor, on themselves, or the person standing next to them. That's a health hazard.

Example 2:
The "penises"that use the WOMEN's toilets are most likely going to leave drops of urine on the seat or leave the seat up. That's a health hazard.

So, on the basis of proper use of the equipment and public sanitation, I have to agree.

As a general rule this is obvious. For the rare exceptions, common sense takes care of the rest e.g. if you're a hermaphrodite dressed like a girl, go to the womens. If you decide instead to dress like a man, go to to the mens. This isnt rocket science

I think you are overdramatizing all this a bit, just like is done in the media on both sides of the issue. People DO let real transgenders be the people they are. Regardless of the bathroom rules, EVERYBODY gets to live a life that is them, because intrinsic to EVERYBODY's life is having to deal with people who want us to be different.

In the case of schools, all students are being forced into situations and experiences that are not naturally them. That is what education is. This hour, they have to be historians. Next hour, they have to be mathematicians. All day they each have to try to develop a mutable identity that both pleases their teachers, and helps them fit in with those peers whose opinions they care about. The bathrooms and locker rooms are incidental parts of the whole process.

Which bathroom people use in public has only a little to do with living "a life that is not them." Even so, adults are capable of working these things out for themselves, and making do when we have to. Most men who go to work in suits & ties for example are, for the time we have to, living lives that are not our own, taking on an imposed identity for 8-10 hours at a time. It is a normal part of adult life to put identities aside for moments or hours, only to pick them up again later.

The nicest thing about the penis-or-vagina rule for bathrooms is that it bypasses identity to match biological plumbing with the bathroom plumbing. It makes the sign on the door irrelevant to the people they are, but adults are free to choose whichever loo they want, regardless of the plumbing.

In the adult world, we don't actually need bathroom identity rules. People are in places voluntarily and, unlike in schools, the parties are equipped to address their individual issues. Adults are able to adjust expectations, and look past irrelevancies.

Or at least they should be.

It is my contention that those people who make a big deal about which bathroom adults use, whether they are directly involved or not, are not actually adult in any sense that matters for social interaction.
