Trump's Travel Ban is Constitutional

When a judge makes a conscious decision to toss away ethics and use their position for political games, and in the process endangers the people of a country, they provide a good reason for congress to act immediately (but I doubt they have the spine). The judges don't even have to be obeyed. Lincoln defied the courts, Truman defied Congress. I don't think Trump will go that far, but the judges are toast, all the same.

 

No, there isn't a double exception. Let me say that again, section 212 grants the president a general power to exclude certain immigrants, however section 202 limits those powers, and specifically refers these limitations to the descriptions listed in section 101, 201, and 203, but there is no exception made to make section 212 overrule sections 202 . In other words, sections 202 sets the exceptions for section 212, NOT the other way around. The claim that section 212 is exempt from the limitations of section 202 is a completely made up detail on your part. Interpreting section 202 as having no impact on section 212 would in effect mean that section 202 was intended to have no restrictions at all.. which is obviously not true, because section 212 was added in 1952 and section 202 in 1965. Section 202 is the updated context of the law described in section 212, not the other way around

and finally, president Johnson's signing statement reads

It's not really a matter of opinion, issuing a travel ban based on religion is unconstitutional under the establishment clause of the 1st amendment, and issuing a ban on immigration visas based on nationality, residence, or country of origin is illegal under the immigration law established in 1965

"no person shall receive any preference or priority or be discriminated against in the issuance of an immigrant visa because of the person’s race, sex, nationality, place of birth, or place of residence"

The only case for the legality of the travel ban is if you 1. prove the opposite of what Rudy Giuliani already admitted, and that this travel ban was not motivated by the prior plan to establish a ban on a religion, and 2. establish a proper exception for recipients of immigration visas.
