    I wouldn't suggest he use the 'I'm ignorant" defense in his upcoming termination hearing.

    The man's an incompetent who couldn't be bothered to remain current on the core aspect of his profession.

    I just read the pertinent sections of Utah law relating to both the legal requirements necessary for the state to draw a suspects blood and the statute that allows certain health care workers to draw blood.

    41-6a-525. Reporting test results -- Immunity from liability.
    • (1) As used in this section, "health care provider" means a person licensed under:
      • (a)Title 58, Chapter 31b, Nurse Practice Act;
      • (b)Title 58, Chapter 67, Utah Medical Practice Act; or
      • (c)Title 58, Chapter 68, Utah Osteopathic Medical Practice Act.
    • (2) A health care provider who is providing medical care to any person involved in a motor vehicle crash may notify, as soon as reasonably possible, the nearest peace officer or law enforcement agency if the health care provider has reason to believe, as a result of any test performed in the course of medical treatment, that the:
      • (a) person's blood alcohol concentration..........

    -6a-523. Persons authorized to draw blood -- Immunity from liability.
    • (1)
      • (a) Only the following, acting at the request of a peace officer, may draw blood to determine its alcohol or drug content:
        • (i) a physician;
        • (ii) a registered nurse;
        • (iii) a licensed practical nurse;

    There is nothing in the above that suggests a health care provider is compeled to draw blood or is in any way legally required to comply with a peace officers command to do so. It's not close, it's not even in the same area code. "May" and "request" The construction of these words in active voice suggests movement but does not set the imperative mood. If the legislature intended to go beyond granting health care providers the liberty to draw a suspects blood and, holding them harmless to effectuate their ability, they would have done so with plain meaning.

    yes you are absolutely moving the goalposts. The context in which I was referencing was current events you changed the context to me past events past events and current events aren't the same thing.

    Further projecting emotions unto me because you're trying to save face is not just dishonest but an ad hominem. I reasonably pointed out why news refers to current events and not history. It wasn't meant in that context nobody would have gotten that context because it wasn't there.

    It has never been in any nurses job to help police supersede the Fourth Amendment. He could have easily got no warrant of course if he had probable cause. That's first week basics at the police academy

    Our local department is a pig pen.

    They get off with murder, they take bribes, and all around are general piles of ****.
    Great, they get a paid vacation.

    This is exactly why i can't respect the police force as a whole.

    Its not one or two bad cops here and there, it's one or two good cops amongst a pile of genetic garbage.

    Don't respect the police, respect individual officers.

    It may not serve as a defense against termination of employment, but it will most certainly shield the officer in question from being held responsible in either a court of law, or a lawsuit. Ignorance of the law is grounds for protection by qualified immunity.

    Often times when a law enforcement officer is truly needed, they arrive long after the fact, long after the victimization has already taken place. In such instances their purpose is to take statements, gather whatever evidence can reasonably be found, and maybe one day locate and arrest the guilty party. None of which will do any good for the one that was victimized before they managed to arrive. Those caught in the riots in the city of Charlottesville in the state of Virginia were certainly in need of law enforcement officers, but they simply stood down and did not interfere when individuals were being assaulted by antifa members.

    The public at large is largely on its own.

    OK. I sure hope the nurse gets a Really Big settlement so the taxpayers in that city know how much they're paying for bad cops...

    Juries do not like false arrest. The city should settle unless there is a solid defense - I do not see one.

    An Idaho police department is hailing nurse Alex Wubbels as a hero for standing up to Salt Lake City Detective Jeff Payne, who tried to take blood from a patient without a warrant or the patient’s consent.

    That patient, it turns out, is William Gray, a reserve officer in Rigby, a city about 15 miles north of Idaho Falls.

    “The Rigby Police Department would like to thank the nurse involved and hospital staff for standing firm, and protecting Officer Gray’s rights as a patient and victim,” the agency said on Facebook. “Protecting the rights of others is truly a heroic act.”

    Gray, who is also a truck driver, was badly injured in July when a suspect in a car fleeing police slammed into his truck. The suspect died, and Gray was flown to the University of Utah Burn Center.

    In the hospital, police tried to take blood from Gray, who was not under arrest and not conscious and therefore unable to consent to the blood draw. In addition, police did not have a warrant.

    Wubbels told Payne he could not draw blood under those circumstances and even got other hospital officials on the phone to confirm that policy to the detective.

    She was arrested, and eventually released without being charged.

    Payne is now facing a criminal investigation. Another officer is also on leave as the incident is investigated.

    The Rigby Police Department said it was not aware of the incident surrounding the blood draw until last week.

    “It is important to remember that Officer Gray is the victim in this horrible event, and that at no time was he under any suspicion of wrongdoing,” the department said. “As he continues to heal, we would ask that his family be given privacy, respect, and prayers for continued recovery and peace.”

    Yes I need to have my freedom pummeled into me for ****'s sake.

    This culture of subverting the law by cops has to stop. The cops were chasing a suspect. That suspect hit the truck driver. The suspect died. The truck driver was a total innocent victim who was struck by the perp the cops engaged in a high speed chase. The cops wanted to take the blood sample from the victim truck driver why:

    1 of two reasons, neither good
    A# wanted the blood sample in hopes that perhaps the truck driver who was the victim any any drugs in system so that the cops don't get sued by the truck driver.
    B# Same as #A except if no drugs were found, would dope the sample.

    B# is not that far fetched in light of the the recent 21,000 drug convictions thrown in limbo after a chemist for 5 straight years was tampering with evidence and falsifying tests.

    And no matter WHAT the agreement between the hospital and the PD is, this is false arrest. It's a matter between the hospital and their employee, not the PD's. Her lawyer is licking his chops.

    hospital ceo better make sure these behind closed door meetings are on camera and have multiple hospital staff as witnesses

    sure this makes nurses safer (sad that is the reality we live in, safer from cops), but how about patients? the only reason to handle behind closed doors is you know the public wont like whats happening behind them, I say keep these interactions in public, on camera - we caught one bad cop this way, how many more could we catch

    does that mean you guys just hate nurses, wait till you need one?

    if a nurse was abusing a patient, I would be upset with that nurse, doesn't mean I hate all nurses, see how that works

    the differences is, if a nurse was abusing patients, she would go to prison, cops get paid vacations... something wrong with that picture
