Mom puts recorder in child’s backpack to catch bullying, now faces felony charge

    She can, the child was presumably aware and agreeable, and the purpose was legitimate.

    In addition, only audio was captured.

    The school and the DA are buying themselves a mess of trouble here; HUGE mistake to bring these bogus charges.

    She and the daughter are both parties, and no encouragement of criminal action occurred, including conspiracy.

    Momma's not just going to win, she will CRUSH as she does so. :)

    I think they're trying to bully the mother - attacking the whistle blower & so forth.

    Mom's a hero now, and the wretches who are going after her are in the spotlight.

    And the mom did so in a legal fashion.

    That she was charged in this outrageous fashion now sets her up for the big win.

    There's no expectation of privacy in a school setting as far as oral communication goes except in narrow circumstances; were this video, a case could be made, but not here.

    While I understand your concerns, charging the mother was both wrong and outrageous.

    Some good points, but as to your last comment about bullying and its handling being a private matter, it isn't, and should not be UNLESS all parties have reasonably consented to that.

    And since one presumes no one would consent to being bullied...

    A classroom is a public place, most privacy laws dont apply to public places.


    And I would absolutely approve of tax dollars beong spent on every classroom being filmed and available to parents of students in that classroom.

    We don't know what the daughter's part in this was, but the mother did nothing illegal.

    Basically, the school - with the DA's help - tried to bully the mother to avoid embarrassment for itself.

    But the mother's not playing anymore - her inner momma bear is awake, so look out! :eek:

    Had that occurred - had the mother outfitted the child with a video capture device - there would be legitimate issues UNLESS the child cut the capture off in such areas.

    I think camera's in the classroom woudl make for better teachers and students

    There was consent under VA state law.

    There is no crime.

    It's the authorities trying to bully momma because they were embarrassed.

    I think you make some good points, and it's unfortunate that the school chose to mishandle this so badly - apparently from the mother's initial reports of bullying through their failure to take proper responsibility when they realized they were being legally monitored.

    But heads will roll on their side; they picked on the wrong sleeping giantess. :)

    some, not others, like the like about the teacher preaching and telling children they were going to hell if they did not believe, they just banned recordings without the teachers knowledge to prevent anyone from proving it again - but at least having the evidence helps the victims to attempt to get justice

    I think copcams are helping too

    I love the... "do you know who I am" video's that get released from them
