If you don't know then on what basis do you claim it was murder? Killing an innocent person can be manslaughter it is not automatically murder.

You mean if they believe they are entering their own apartment where they found the door ajar.....................or if they force a door or a window in a criminal trespass?

Walking into his apartment without his permission was a trespass, in fact it was a breaking and entering

Ooooookkkkkk, how many folks will fly a plane as compared to the number of folks who will rent an apartment.

She pulled out her gun and pulled the trigger.

It is when you intentionally kill them.

Imperfect self defense. Manslaughter. We've been over this.

How is it self defense when you are the one who is attacking someone in their home. He never attacked or threatened her.

Their is no "fear for my life" language in Texas law. You can justifiably kill to prevent murder, arson, rape, aggravated assault, armed robbery, or when someone breaks into an occupied home or vehicle. Then there is the "reasonable" mistake clause. It all comes down to is the mistake "reasonable" to the jury.

Politics and political correctness are the only reasons she was charged.

Her mistake is unusual in the extreme but entirely reasonable.

IF that is actually the case I can see her getting convicted of some degree of manslaughter. Depends on the jury, as always.

What part of imperfect is unclear?
You realize I'm talking about a particular legal concept?

That's up to the jury. I don't think it's reasonable.

Yes, you can. The jury will decide that.

It is a good thing Amber the Killer didn't walk into a restaurant and kill everyone because she thought that they were in her dining room.

Right. The excuse-making on this is pathetic.

It really does matter as long as the conviction must be beyond a shadow of a doubt

You claim she murdered the guy but dont know whu?

That spells not guilty to me

But of you merely chagre her with wrongful death thats sure to get a conviction

You think everyone in prison for murder knew their victim and a particular motive why?

She’s already admitted to intentionally and deliberately killing him.

She wrongfully took a life so some punishment is due

But did she murder someone in cold blood?

I dont think the DA can prove that
