What happened to Client/Attorney privilege

    Your attorney talking about in congress, your client/attorney discussions and actions? I thought that it was privileged information. I see now you tell your attorney nothing. If you tell him you really did the crime, he can testify against you?

    There is no attorney client privelege when the topic is whether the defendant broke the law.

    Of course privilege applies, and it's exactly why Trump's legal team reviewed Cohen's testimony. Executive also may apply. Cohen didn't specify what he alleges Trump's team "edited" either. Then proceeded to yammer about Trump's secret unspoken code. :roll: What's that ... wink, wink, don't lie to congress? :roflol:

    Well Cohen broke the law and provided no evidence his client Trump did. The testimony was a joke and Cohen repeating Schiff's lines word for word was hilarious.

    But what if Trumps team said everything is privileged? Sorry, but I guess I have to lie to my attorney so he doesn't "out me". A free lesson learned.

    Not true. But I think I know where you are headed.

    In the end, Cohen would face sanctions and disbarment. Given his convictions, his days as an attorney are over, so he doesn't care.

    What people should keep in mind is Cohen's carefully orchestrated speech means very little. It wasn't a courtroom appearance, and he faced no cross examination to speak of.

    If you confess your crime, your attorney is obligated to inform on you. Not "sometimes" ... EVERY TIME. Trump could have made that legal argument ... EVERYTHING is privileged ... but team Trump was intent on cooperating with the investigation.

    Under most circumstances an attorney or client cannot be forced to reveal their discussions. In this case Cohen is volunteering information.

    No he is not obligated to inform on you. Many guilty people inform their attorney that they are guilty. He can refuse to represent you or can advise you of the best way forward.

    Your attorney cannot enter a not guilty plea on your behalf. He must remove himself and explain why to the court. He will inform the court he is potentially a material witness for the prosecution.

    This is incorrect. If a client tells an attorney he has broken the law, the privilege covers that communication. But if the attorney assists the client in breaking the law, the privilege does not cover that conduct.

    Michael Cohen is no longer a practicing attorney. He was disbarred a few days ago. So the consequences of giving away attorney-client privileged information are non-existent to him.

    It may not be true. Certainly it is privileged. The hearing was entertaining but embarrassing for me as an American. I can say that about all the TV spectacles presented by congressional committees. And they wonder why they have a single digit approval rating.
