A confidential Internal Revenue Service legal memo says tax returns must be given to Congress unless the president takes the rare step of asserting executive privilege, according to a copy of the memo obtained by The Washington Post.

The memo contradicts the Trump administration’s justification for denying lawmakers’ request for President Trump’s tax returns, exposing fissures in the executive branch.

Trump has refused to turn over his tax returns but has not invoked executive privilege. Treasury Secretary Steven Mnuchin has instead denied the returns by arguing there is no legislative purpose for demanding them.

But according to the IRS memo, which has not been previously reported, the disclosure of tax returns to the committee “is mandatory, requiring the Secretary to disclose returns, and return information, requested by the tax-writing Chairs.”

“[T]he Secretary’s obligation to disclose return and return information would not be affected by the failure of a tax writing committee . . . to state a reason for the request,” it says.

The few voices of dissent, Flake, Corker, and McCain (before he passed away) have been silenced. Try to concentrate. The matter at hand is President Stonewall's lame justification for not turning over his tax documents. The IRS memo states........."The 10-page document says the law “does not allow the Secretary to exercise discretion in disclosing the information provided the statutory conditions are met” and directly rejects the reason Mnuchin has cited for withholding the information."

What happened since that memo was drafted is the folks I mentioned.......those complicit in helping Crooked Donald.........have manufactured a rationale for refusing a legal request for the returns by the Ways and Means Committee. Team Turd has tried and failed to suggest there is ambiguity in the law. There isn't.

Congress needs to rethink its strategy. The White House has and will continue to block every subpoena and claim executive privilege at alarming rates. The Mueller Report, far from an exoneration, should have laid waste to the foundation, it didn't. Congress, on both sides is intellectually lazy or obtuse. Nobody, it seems, has actually read the report so now, it must go on the public stage to garner the attention it deserves. This will be Congress' goal, go public and a big way.

My conservative party, once the GOP, has corrupted itself over the years and now stands as a horrible example of corruption in government. The stonewalling by the President, cabinet, lawyers, and the GOP Senate is a massive attempt to subvert the law and obstruct justice. Even the Nixon administration never touched this level of misconduct. It appears Congress' next step will subpoena second and third level players and jail them for noncompliance. Then work their way up the chain. We'll see what happens in the next few weeks.

 

Assuming the intellectual equivalent of a fetal position due to your inability to mount a defense doesn't surprise me.
