Except for the fact that such cannot be done. The government would have to demonstrate that the current malfunctions, such as failure to cycle and failure to fire, pose a risk to the general safety of the population, when what malfunctions do is prohibit firearms from operating and thus rendering them useless.

That matter aside, the existence and presence of firearms in public, in the possession of private individuals, is not a sufficient threat to general safety to support a total prohibition. Therefore trying to prohibit supposedly faulty firearms does not do anything to benefit the general safety of the public at large, and would never pass constitutional muster.

 

Ammunition and firearms are complementary goods that go together. One cannot be had without the other, so constitutional protections that apply to one apply to the other by direct extension. Such is how the legal system in the united states works.
