    Mother's can claim their children on their tax forms.
    Can a pregnant mother claim a fetus in her stomach as a dependant?

    Maximal statists who are fanatical about politicians seizing control of wombs from the instant of conception may need to label a 12-year-old rape victim with a mindless, microscopic amalgam of cells in her body as a "mother" but semantics is not the issue.

    In the 22-24 week gestation period, there's a 25% chance of fetus survival outside the womb.

    However, according to the study, babies born at 22 weeks had a nearly 25 percent survival rate if actively treated in a hospital.

    A similar argument can be made that an obviously embalmed Supreme Court Justice is no longer really a justice. Her assertions would seem to prove that point.

    Are we going to start filling out death certificates for aborted (naturally or artifically) fetuses and zygotes next? Seems logical if we're going to pretend that these qualify as persons the same as children who have been born or who are at least far enough along in development to be viable outside of the womb with medical care.

    Your argument is bass ackwards. It is not up to the choice advocates to prove that a zygote, embryo, fetus (at what ever stage) is not a child.

    It is up to those that want to make law restricting individual liberty to prove that a zygote, embryo, fetus (at what ever stage is being referred to) is a child.

    This is the difference between morality an Law. The founding principles and principles of Republicanism put individual liberty "Above" the legitimate authority of Gov't. This means that Gov't is to have no legitimate authority - of its own volition - to make any law that messes with individual liberty.

    On the other side one can argue that protection from harm is the legitimate authority of Gov't. "Rights/individual liberty ends where the nose of another begins".

    If one is to make the above claim - it is incumbent on the claimant to prove that the entity being referred to is a living human - a child.

    In this case we then have a conflict between the rights of the woman and the rights of the zygote, embryo, fetus. The courts are then to weigh the rights of each on the scales of justice.

    Unfortunately - at least in the early term - the best place pro-life can get to is "Experts Disagree". There is no consensus among subject matter experts that the zygote is a child. In fact - I would claim the reverse is true - but this matters not.

    As soon as you get to "Experts Disagree" - this means "we don't know". You are basically arguing for making law on the basis of "we don't know otherwise" - and this is a preposterous justification for law.

    On one side of the scale we have the rights of the woman - the founding principles of respect for individual liberty. This is a heavy weight.

    On the other side we have "we don't know". How on earth do you put a value on "we don't know" ?

    It is no contest - the rights of the woman win by default.

    What choice did the mother make?
    You see, the way the law is today, is the future mom to be has the rights and can afford said rights to her future child. If the pregnancy goes well.

    And just how do you see a doctor doing an abortion without permission?
    And would that not be the same charge brought against a person who kills an expectant mom and her fetus? I would think so. So why the need to ask the question?


    What if the baby aborts itself? Who should be charged, and with what?
    God sent to hell?

    Assault.

    If the fetus is viable the doctor may be charged with more depending on what state he's in....could be manslaughter


    What should the charge be if a woman is forced to gestate ?

    Could be assault since gestation does cause damage and murder if the woman dies..
