McGlockton initiated the act of physical force when he shoved Drejka to the ground. Drejka gets off.

He's a "good guy with a gun" don't you know? We don't need police anymore. We have angry armed white men. We don't need courts either, the penalty for everything, even parking illegally, is now death.

You can stand your ground but you still have to be in REASONABLE fear for your life. You can't just kill someone who is retreating. All the gunnies say no because killing someone is their fantasy. This guy is living their dream.

Only in florida can you shoot a man in the chest, and it be called self defense, when there is obvious no threat to your life.

In most states, self defense ends the moment someone pulls out of a confrontation. The DA agrees with that assessment, it seems, and is charging him because there was obvious no threat to his life, and he shot him in retaliation, and not self defense.

I remember this case, while yes, the gun owner was being a jerk, the victims using excessive force in anger got him killed, he gave the gun owner an excuse

this will be a tough case as a juror, don't like the shooter actions, but did he actually break the law, had he shot him and not be assaulted first, would be an easy case

when you assault someone, just taking a few steps back is not enough to be considered retreating, could just be preparing for the next attack, how far away was he when he made the first attack run?

this is a sad case, but that assault before the shooting makes it not such a easy call

you don't resort to violence, or you may get shot... this could of been resolved with non-violence and calling the cops - he would still be alive today

she was being berated for parking in a handicap spot if recall correctly - yes, the guy was being a jerk to his wife, but violence was not the answer

Unless you REASONABLY believe someone to be armed themselves I don't see it. The key word is 'reasonable" here and you ARE pointing a loaded gun at someone who appears not to even have one of their own, let alone be pulling it out.

Was she being berated or attacked? Verbal confrontations can look very physical when seen from a distance

A person doesn't have to be armed to cause someone to fear for their lives and for that fear to be well founded. Maybe he stepped back to give himself room to kick the guy on the ground.

did not see signs of an attack, just a guy being a jerk verbally - it would make any husband angry, but not assault them

had he not parked in a handicap spot and not assaulted the man, he would still be alive today

A single step taken back at a sudden confrontation, is not sufficient to qualify as backing up. Certainly to not any degree that would classify the violent assault as having stopped entirely, or otherwise insured the physical threat is no longer present and able to reengage at any moment.

And yet another case where a black male individual feels they are entitled to do whatever they wish, whenever they wish, and no one is going to tell them any different.

Had the deceased simply refrained from parking in a handicapped spot he was not legally entitled to, or had simply refrained from engaging in physical violence against the accused, he would still be alive today.

After watching the video, this is murder. But the black guy is also partly responsible for his own death.

Drejka has history of threatening behavior. It can also be seen from the reactions of the other customers entering the shop that Drejka was acting in a threatening manner towards McGlockton's wife.

Your video has clipped the wide angle footage and has removed the reactions of other customers entering the shop witnessing the event prior to the husband going out

Court filings detail three incidents where Drejka allegedly harassed other motorists. Richard Kelly, a truck driver, told the sheriff’s office that Drejka threatened to shoot him after he parked in a handicap spot at the same store about three months ago. It is unclear if he came forward before or after news spread of the July killing.

Kelly told police that Drejka rummaged in his center console for something, and Kelly sped off, according to a criminal complaint obtained by The Washington Post. Drejka allegedly used racial slurs during the encounter. Drejka is white and Kelly is black, the Tampa Bay Times reported.

Drejka learned Kelly worked at AA Cut-Rate Septic Tank Service, the documents show, presumably from the truck he drove, and called Kelly’s supervisor. Kelly was “lucky I didn’t blow his head off,” Drejka allegedly told his boss John Tyler.

In two other incidents, drivers alleged similar threatening behavior. In January 2012, two teenagers stopped at a yellow light without driving through. Drejka was behind them, and he allegedly brandished a pistol after a confrontation. They declined to press charges.

In December 2012, a woman told police a man waved a gun at her for driving too slowly through a school zone. He was later identified as Drejka, who denied the accusation, the documents show. No charges were filed.

And yet, in each and every single incident where these individuals were supposedly threatened by the same person, and threatened with a firearm, not so much as a single one of them ever sought to press charges against him.

Why exactly is that? What serves as motivation to convince someone to not press criminal charges when they are threatened with a firearm, if they are not engaged in illegal activity at the time of the incident?

So now the penalty for illegal parking is death.

If the 5-year-old son had a gun it never would have happened.

Err, people can't be bothered, obviously! Do you think that they were all making it up, even the two cases going back to 2012?

I blame the ADA (Americans with Disabilities Act). It created this unjustifiable rage in folks who also might have guns... Shame really. Guess we should dump the ADA, and this false sense of disabled entitlement will disappear with it.....

nope, that was the penalty for the assault... no assault, no death

the penalty for being a dick about someone parked in a handicap spot was the assault and all the legal hassles this guy will now face

neither party handled this situation well and it led to a person being shot and killed - had either behaved better, this outcome could of been prevented

FIRST: Is the shooter handicapped - was it his parking place?
SECOND: Is the boyfriend or the child (who were both inside the store) handicapped? Did the shooter know that?
THIRD: Did the boyfriend know why the shooter was making such a fuss and getting aggressive with his girlfriend?
FOURTH: Was the shooter outside of his car? How close was the shooter to the girlfriend?
FIFTH: Was the girlfriend inside her car or outside?
SIXTH: Was the shooter standing inside the parking space lines?
SEVENTH: Is it lawful to shoot someone dead for pushing you?
EIGHTH: Is the parking space considered the "ground" of the car occupants?

So who was standing whose "ground"?
