    If there was no obvious danger to his person, he wouldn't be pointing the gun.

    Can you shoot at someone, miss, then take a step back?

    There's no safe spaces in an aggravated assault.

    he may not of even meant to shoot, we just do not know yet, could of been just a twitch from the adrenaline from just being assaulted as he was trying to get up, fight or flight makes people not see things as clearly as a calm person not facing any danger, so maybe he did intend to shoot as from his perspective the threat still existed

    Yeah, that just made me realize that he had no idea who that guy was.

    Did he know that was her boyfriend? I doubt it, at least initially.

    She was in the drivers seat (since he lost his license apparently), the guy that was shot was not in the car when the shooter pulled up, and it appears he didn't attract attention to himself or say anything before shoving the guy to the ground.

    So instead of apologizing for parking in tje handicapped spot he charges at the guy? You cam just go around shoving people. One less idiot to worry about..the shooter did nothing wrong

    The OODA loop decision to fire was made when he was attacked.

    Four seconds and a step back doesn't change the OODA loop.

    I predict not guilty or hung jury, just like this thread, I think this is gonna be a tough case for a jury to decide - the guy is not likable in the least, that could make it easier for a jury to decide guilty though

    the sheriff will be a defense witness as to how he thought the shooting was justified, that could help create doubt in the jury

    I also predict he is sued by the family and loses

    I wonder if his attorney will even call him to the stand, or better yet, come up with some excuse (frail health?) why he can't even be present at the trial at all, if he's seen as that unlikable.

    See it all the time. A car pulls into a handicapped parking space, the driver hangs a handicapped placard on their mirror gets out of the car with a couple of kids and goes all through the store without any need for one of those carts, no limps, brisk walk, rounding up kids etc etc. What do they tell their kids when they ask "Mommie you aren't handicapped and none of us are why do you park there".

    What was the threat? He didn't pull the gun on her, was not threatening to physically assault her. He was pointing out she was illegally parked in a handicapped space, how is that a threat? Why didn't she just move her car?

    yes, had the boyfriend not of been shot, he probably would of beat an assault charge - but assaulting people has other risks... like getting shot

    the man had reason to be upset, no doubt about it, but resorting to violence was his mistake

    just like the shooter had right to be mad about the parking in a handicap spot, but his actions were his mistake

    all of this is what led up to the shooting, either man could of prevented this had they behaved differently

    8 years ago and 11 years ago! So sure, use that history as well as clearly you think that the shooter was enacting Charles Bronson and see how that works out

    When a doctor recommends a handicapped placard, they should have to go to a state doctor for verification.

    Won't have to. When you're the victim of an aggravated assault you can legally shoot them, even if they take a step or two.

    Standing 5 feet away from the car pointing is threatening?

    Did he pull his gun and threaten her? Did he try to open the door? Did he assault her?

    No.

    My guess is he'll get manslaughter. The shove to the ground will rule out 2nd degree murder, but the fact that the victim backed off will prevent acquittal.

    I came on here to point out that cops don't get to make the decision on whether someone acted lawfully or unlawfully.

    I don't believe even the woman said he physically threatened her and as vman12 noted she got out of the car, that doesn't sound like someone who is being threatened. If he was beating the woman or had the gun pulled on her then yes then her boyfriend would be justified in the assault. You do realize that had he not been shot he would have been arrested and taken to jail.

    Ahh...so you admire people that are able to capitalize from their disability and all other disabled people are nothing more than whiners? Bleier (not Blair) is certainly worthy of admiration.....but you do not feel that other able-body people should be "inconvenienced", empathetic, or compassionate? Got it. Personally, I am not a self-centered putz that lack compassion for the struggles of others, so I find your views quit deplorable.
