California man detained, given citation for eating sandwich on BART train platform

    Im not sure about that ratio, but I do agree that Reps are the lesser of evils.

    a) not all, some are assumed, like speed limits in residential area's, in my city its 25mph unless otherwise posted, and pleading ignorance doesn't always get you out of a ticket but if you are super nice about it it might. If there are glaring issues with no adequate signage, perhaps like this food thing or maybe "no smoking within 50 feet" it should be posted pretty clearly, why not just apologize to the cop and ask where the sign is posted so as to clear up any confusion for next time. <no ticket, have a nice day. Or at the very least a simple ticket with a small fine, have a nice day.

    b) he should answer the question, but it depends on the flow of the conversation, if the citizen starts right off being a defensive dik about it, then the nice part of the conversation is immediately over and the power trip begins, which is the primary reason i'm not a defensive dik when talking to cops

    FWIW I tried that once in my 20's, it did not go well, I ended up with 2 tickets and was delayed 30 minutes because LEO had had enough with my attitude about 15 seconds into our conversation and next thing you know its "step out of the car sir" I could have just been polite and likely gotten off with a verbal warning, which is why I'm shockingly over-polite now, within 30 seconds i'm chatting with them like we're old friends.

    When dealing with positions of authority, (boss, cops, parent) Politeness gets you out of trouble most times, Rudeness gets you INTO trouble most times. <its common sense.

    Most of the time, yes, especially in areas that are common areas and have a designated smoking area. And yes, laws are posted EVERYWHERE.

    Cross walks
    No Trespassing
    Speed Limit signs
    School Zones
    Traffic signals
    etc.

    These all help define were you can and cannot get a potential citation.

    Why does the pedestrian have to answer the officer if they feel no crime was committed?

    BTW, I'd never advocate in being difficult to a person of authority. Me personally, find that to be EXTREMELY stupid. If I feel slighted, I'll have my day in court.

    Control is the point of government.

    Every regulation is an attempt to control some type of behavior or another.

    Not sure I agree that he should answer the question. The arrest is not the place or time to have a trial. He's not there for an extended argument. It's certainly important for the guy being arrested to point out that they didn't see a sign, but it's definitely not the time for the cop to argue with the person about the facts.

    For example, there isn't a single sandwich anywhere to be found in this photo.

    yes, exactly, its NOT the time and place AND if he would have just given his name and accepted the ticket, if he so chose later on he could investigate the signage or lack of it, and present his case to the judge if that's what he wants to do. <I'm just paying the ticket unless its ridiculously high, if its like $50 i'm easy money. In this case I politely plead ignorance, give my name, send the check.

    I'm over 50 so I've been pulled over at least a dozen times, half on the roadways and half on the waterways when I owned a couple of jetski's (cops generally hate jet ski's) I've only been ticketed on two occasions and in one case I was being a dik, so I'm running about an 90% success ratio where being polite and compliant has ended up with me getting a warning and left with both parties happy.

    I like my system better than this guys.

    Over 130,000 homeless, almost a quarter of the nations homeless, live, eat, sleep, do drugs, and defecate on the streets of California's cities. But let's not let a guy,on his way to work, eat a sandwich on the BART platform because he might drop a crumb or leave sandwich wrapper behind.

    Gotta love California!

    State law prohibits eating in the paid area of the BART system. Law enforcement in that BART patrons routinely eat sandwiches and other food on the platform and BART trains without any law enforcement intervention, chastisements or other admonishments by police. Rules are to be enforced so that people obey them. Buses and other transportation unite have those rules to keep their places clean. I you want to eat, eat at home.

    I disagree with you. They have obviously had issues with people in those areas making a mess. It's not all public areas, just certain public areas. And besides that area is a pay public area, you have to pay to get in.

    You don't understand what some of these people who use BART in that area are like. They are not respectful and don't bother to clean up after themselves. We're talking about the same area where drug addicts can be seen openly shooting themselves up in the corridors, not exactly "civilized high society".

    I have no idea what you're talking about. I was saying that you're not allowed.to eat in the subway system in DC, and that I support that law. According to other posters, there is a similar regulation when using BART.

    Worse. It appears to be the human weakness for needing to control others. We need to put more value on freedom. The sandwich eater wasn't hurting anything or anybody and should have been left alone. I have no explanation for California.

    just like smoking, speeding or running a stop sign, had he showed his id and stopped eating, would have got a ticket and been on his way - he was even given a warning first... but did not stop, that is when matters escalated
