Laws against murder rape and theft were not enacted to prevent murder rape and theft, but to punish people after the fact.
Laws enacted to prevent people who should not have a gun from getting one were enacted to prevent the crime of illegally getting a gun, not punish it afterwards.

A sound argument that the latter set of laws fail to achieve their goals and are thus useless is in no way an argument against the former set.
