The guidelines provided by Congress are in regards to national security. Trump has taken that to mean that he can just say the words "national security" and issue whatever tariffs he wishes, even when he has publicly expressed motives other than national security. A lot of this has to do with the fact that he doesn't understand what trade deficits are.

As for public interest: you overestimate how interested people are in Constitutional minutia. Most of the people I've had this discussion with were not even aware that taxes were a Constitution power until I brought it to their attention. Plus, the far left would LOVE to have this power when they take over, so of course they don't want to speak up too much about it.

Right, so where's the judge's order? Seems the House has written the judiciary out of the Constitutional equation here.

Seems also that Shiff acted illegally under the color of law.

I'll settle with life in prison, but want more!

Not without presenting it to a judge and the judge agrees.

Ya' can't be serious here, can you? The investor gets to determine probable cause? WTF!?

They probably went through a FISA court and used the Steele dooseyaay as justification.

Hmm. Maybe Nunes should be the one to testify. :)

If he has some info of Schiff's corruption, sure. It doesn't seem like he knows more than we do, though.

Actually there's far more to it than simply national security. Even CNN admits that Trump has the ability to law these tariffs. And considering how anti-Trump CNN is you're going to have a hard time disputing what they say. I'm sure that if they could have they would have already spun this to "an abuse of power" or some such. Here's the link if you wish to peruse it. Link: President Trump can levy tariffs without Congress

Not sure what this has to do with my question to you? Or was it a part of just addressing my first paragraph? In any case Trump isn't the first President to impose tariffs without congressional approval. He also won't be the last. Unless of course Congress takes back their authority. Whether you agree that they have delegated this authority to the President or not is immaterial to the fact that they have. And unless you have evidence that he has abused this power then you really don't have anything other than your opinion.

I care more about what the law says than what CNN says. And all 3 of the examples they give are around national security.

Which, even if that weren't a piss poor excuse: what other President has stepped outside Congress's guidelines and issues tariffs without Congressional mandate? I'll gladly condemn too. You can accept "other people have done it" as an excuse if you want; I won't.

There is nothing to take back. The authority is theirs.

If they have, and they haven't, then their action was unconstitutional.

What part aren't you understanding? Power belongs to someone else. He is taking it. Abuse.

The Constitution is not my opinion. I have what the Constitution actually says and the SC's support on the non-delegation part, which is also just basic Constitutional literacy.

Constitutional lawyer David Rivkin makes the case that Schiff has opened himself up lawsuits from targets of these subpoenas.

So you support Congressmen using secret subpoenas to get information on their political opponents and the attorneys of persons they are investigating and the press........gotcha

Maybe Nunes can go after Schiff's and staff and Nadler too. Surely you won't object.

There is no reference to secret subpoenas in the OP. The closest reference is this question.

So you're OK with this? And will be when the other Congressman start secretly getting each others records and those of the press theybdon't like and those of the attorney's representing persons they are investigating?

The persons whose information were not made aware of it and he did not get court approval for wait is basically a search warrant. And he did so not for legislative purpose. You understand he not a criminal investigator. He not a law enforcement officer. And we have a 4th amendment.

Parnas & Rudy. Quite a pair considering. Of course he's not sure about Parnas. Maybe it was a butt dial that lasted 8 minutes. :) Just farting around.

By this point it isn't even clear these were the results of subpoenas. Or "secret." Or that the motives you are describing were the only factors. And, yes, regardless, I do think Congress should retain its subpoena power.

Remember, at this point in time that one of the other people in this fiasco had already publicly flipped on Nunes and was offering to cooperate in the investigation. If feel like that bears repeating. So, a Congressional committee chairman has used the power of his office to dig up dirt on a political rival.

    Too funny.

Why were they even obtained and how did he get what was essentially a search warrant. He's not a criminal investigator.

That's it in a nutshell. Not illegal, but the very same thing Schiff is accusing Trump of doing.

The Power may belong to Congress per the Constitution. But they have delegated that power to the President. If you don't think that they are allowed to do that per the Constitution then feel free to sue them. Your first amendment right includes suing the federal government for grievances.

I think we have a pretty good idea. So you're OK with this? And will be when the other Congressman start secretly getting each others records and those of the press they don't like and those of the attorney's representing persons they are investigating?
