In any case, I wonder why the OP doesn't focus on the many bystanders who tried to calm down the situation, which no doubt is a personal conflict, which happens between young males many times, no matter what the politics are. Not allowing someone to use a bathroom became a national crisis, but the left's intolerance and how they violently react is ignored. Nothing will happen to this guy. Nothing. But had he been a conservative and the black guy a liberal, then everyone would instantly change. This guy was more violent than anything that ever happened to Smollett and look at the different reactions by the left. And did you notice that no one called the guy a Nazi, supremacist or nationalist, and no one called the black guy a victim of racial hate. I wonder why?

It's considered subjective test. If the judge deems that if the violent attack was not stopped, the threat of death could be validated, then yes, the charge could be a felony.
