    If Trump has been impeached, the Senate can hold a trial whenever it wants.
    If the Senate cannot hold a trial, then Trump has not been impeached.

    But the indictment (articles) weren't a complete sham?

    How can the democrats control one house of congress and claim their vote was valid, but oppose the other house controlled by republicans would be a sham?

    Should the 5th amendment not apply to impeachment?

    Get the evidence and present the democrats case.

    Saying now they don't have the evidence pretty much says the entire House proceedings were BS.

    Regardless what Sen. Graham is saying about moving forward, Mitch McConnell's last statement says he's more than willing to just let Nancy sit on the articles, for now. He's got real Senate work do, like confirming judges.

    "We can’t hold a trial without the articles. The Senate’s own rules don’t provide for that. So, for now, we are content to continue the ordinary business of the Senate while House Democrats continue to flounder. For now." McConnell, 1/3/2020

    Nancy is obstructing the Senate, whom the Constitution gives the SOLE authority for an impeachment trial.

    He should have. But he didn't.
    He made the mistake of saying he was in bed with the Whitehouse and was taking direction from Trump.
    In the meantime more info is coming out.

    Nancy can't obstruct the Senate - if Trump has been impeached, the Senate can hold a trial and the House can't do a thing to stop it.

    The actual status is Trump has been impeached, but the trial cannot begin until the Senate receives the articles.

    Which I imagine will happen on Friday...

    Once the President is impeached, the Senate, who must try all impeachments, can start the trial any time it chooses.
    The house cannot in any way limit the Senate in doing so.

    Republicans are placing themselves in the unenviable position of being recorded in history as the first generation of American politicians since the Civil War, to consciously & willingly ignore their personal oaths to "preserve, protect & defend" the Constitution of the U.S. That Constitution makes the Congress a co-equal branch of government alongside the Executive branch headed by the President. That Constitution gave the House the sole right & power of impeachment, & the Senate the right & responsibility of giving a "fair & unbiased" trial for anyone impeached by the House. Republican Majority Leader Mitch McConnell has already failed to live up to his oath of office when he single-handedly refused to consider the last Supreme Court nominee of the Obama administration during its last year in office. Now he defies his Constitutional duties again by publicly stating he will not work for a "fair trial" in the Senate, but will work in league with Trump's personal lawyers to assure Trump's acquittal. These actions are based on party politics rather than loyalty toward the Constitution. But McConnell isn't acting alone. The entire Republican party is acting in concert with him to defy the intent of the Constitution itself, & that action undermines the authority & strength & meaning of the Constitution, & endangers all the rights & privileges guaranteed for all Americans by that Constitution. As a former history teacher, I would not want to be one of those Republicans staying in lock-step with McConnell or Trump in these matters. History will not be kind to them. For anyone who values human rights, these Republicans will long be remembered as examples to be avoided.

    It takes 51 votes to change the rules, which the senate can do any time it chooses.
    Thus:
    Once the President is impeached, the Senate, who must try all impeachments, can start the trial any time it chooses.
    The house cannot in any way limit the Senate in doing so.
