Black man dies after video shows officer kneeling on neck

    The use of his knee on the neck was knowingly an excessive use of force by the officer. It clearly caused the man to suffer and fall unconscious. At that point he knew of the damage and harm yet kept the knee and pressure on for several additional minutes. Murder 2.

    It is irrelevant that he resisted arrest - Once the perp is on the ground - "IN CUFFS" - with 3 other officers present - you do not kneel on his/her neck for 9 minutes

    The officers have the right to use extreme force to overcome the resistance. What they do not have - is the right to use extreme force after that resistance has been subdued. .

    The cop already had him more than subdued after he was handcuffed and after putting his knee to his neck for a few minutes. The rest after that point was murder.

    Middle ground. Second degree murder. Worse than manslaughter (3rd degree) and does not require premeditation.

    What this cop did fits Manslaughter 2.
    If prosecutors charge him with Murder 2 the cop will be acquitted and because in the US you cannot try someone twice for the same crime the cop walks away after he killed someone for no good reason.

    Manslaughter 2 means 10 years at most, but if they pile on excessive use of force and a few other parallel charges they can lock him up for up to 15 years. I think that would be a fair sentence. Why risk the cop walking away by overcharging him just to feed the crowds emotions. I often mention Casey Anthony because that’s exactly what happened in that case.

    if the intent was to harm and the man died, that is murder, there was no reason to do this like that cop did, he was just being a jerk and a person died

    Well, Minnesota government is being stupid now.
    There is enough evidence to lock up immediately at least 1 cop, the one who pinned down the victim. So, why the hell is he still free? They can calm the crowds by arresting that cop.

    If you are referring to the 80% unsolved murder rate in inner city slums, I couldn't agree with you more. There is no justice for each of those thousands of black victims and no peace for their neighborhoods. Can you imagine living in an area where 80% of the murderers are never caught? It must be a literal hell on earth. Thank you for that post. I am glad that we can agree on something.

    Manslaughter is a lesser included charge for a Murder Indictment in Minnesota.

    They could charge it as Murder and return a verdict for Manslaughter.

    Upon an indictment or complaint for murder, if the jury finds the defendant not guilty, it may, upon the same indictment or complaint, find the defendant guilty of manslaughter in any degree
