    I'm not clear on where he is trying to go with this. Our law (for good reasons) limits designation to FOREIGN terrorist orgs; DOJ refers to Antifa as DOMESTIC.

    Trump has all the power he needs to effectively bring Federal Power against these lawless insurrectionists

    Article IV of the Constitution and the Insurrection Act empowers the president “to suppress, in any State, any insurrection, domestic violence, unlawful combination, or conspiracy.” Obviously, suppressing such attacks requires deploying the United States armed forces as needed.

    And for empowering US Attorneys to being the full weight of Federal Law against these organizations of violent extremists attacking and attempting to destroy our civil society, our statute that criminalizes “seditious conspiracy” fits well. This law targets conspiracies to levy war against the United States, or to forcibly oppose or overthrow our government. The key element is violence – either its use or planned use. That is the attribute that fundamentally distinguishes legitimate protest from insurrection.

    It is a federal crime to cross state lines or use interstate facilities in order to incite or participate in rioting, this also raises the specter of federal racketeering laws.

    The racketeering enterprise must affect interstate commerce through a pattern of criminal activity. This would enable the Justice Department to investigate outfits like Antifa, which are organized around a nihilistic vision and which dispatch members throughout the country to commit mayhem, seriously injuring Americans and destroying property.

    The job is long overdue. The ravaging of our major cities right now is a violation of the rights of peace-loving Americans, both those who are legitimately exercising their First Amendment rights to protest, and those who are going about their lives expecting the governmental protection to which the Constitution entitles them.

    The Posse Comitatus Act has always been subject to express constitutional and statutory exceptions, and the Insurrection Act is such an exception.

    The Insurrection Act is the Posse Comitatus Act’s most important exception. This is the legal key that unlocks the door to use federal military forces—whether through federalizing the National Guard or calling in “title 10 forces” to quell civil unrest. Dating from 1807, there are three key Insurrection Act provisions worth addressing.

    First, a state legislature or governor could request assistance from the president under 10 U.S.C. § 251 “to suppress [an] Insurrection.”

    The Insurrection Act authorizes the President to deploy the military (federal or state) whenever he believes it necessary “to suppress an insurrection, domestic violence, unlawful combination or conspiracy.”

    Third, the president can use the armed forces when there is an interference with federal or state law. The president may use the military to suppress insurrection, domestic violence, unlawful combination or conspiracy if:

    (a) it so hinders the execution of law of that State and of the United States and it deprives citizens of constitutional rights (e.g. due process); or
    (b) it opposes or obstructs the execution of laws or impedes the course of justice. In the event of the deprivation of rights, the State is deemed to have denied its citizens equal protection of laws.​

    We elected an incompetent semi-facist clown, who wasn't legally removed by 52 sheep when we had the chance. Thus the need for something anti-facist.

    Trump was under zero actual threat. But while I certainly don't advocate stepping one illegal foot on WH grounds, if I had my way, full bore anti-Trump protests should be going on outside the WH 24x7 from now until the election.

    He's earned it.
