Witnesses: Phoenix Cops’ Account of ‘Armed’ Man Shot Dead in Parked Car Is Wrong

The Phoenix Police Department is under fire after several officers were caught on video surrounding a parked car on July 4 and threatening a man inside before unloading at least ten gunshots in a gruesome incident that has sparked renewed protests.

James “Jay” Porter Garcia, 28, was fatally shot while parked in a sedan outside his friend’s one-story Maryvale home, a police spokesperson confirmed to The Daily Beast. In a now-viral video captured by a bystander, at least four officers can be seen surrounding his car—two with their guns drawn—after responding to an aggravated assault call.

“Hey, stop ******* moving. I will ******* shoot you,” one officer can be heard yelling, while other onlookers across the street beg officers to “put the gun down” and “don’t shoot him!”

Seconds later, the officers fired at least ten shots into the car. Authorities later said Garcia pulled out a gun and repeatedly told officers to shoot him.

However Jacqueline Fernandez, Garcia’s sister, wrote in a Facebook post her brother was “unarmed sleeping in the car” when police shot him. Several other witnesses told KSAZ that Garcia was unarmed, but authorities “made sure he was dead” anyway.

“He was not asleep when he was interacting and speaking with officers for approximately 10 minutes,” a police spokesperson told The Daily Beast.

On Sunday, residents protested outside the Maryvale Estrella Mountain precinct in a tense demonstration that resulted in 30 officers responding in riot gear.

While the details of the fatal shooting are still under investigation, authorities on Monday released the 911 call and a 44-second body-camera clip after protests erupted in Phoenix over the weekend.

“It does not shock us that despite all the scrutiny from [the] community Phoenix PD continues to respond violently to calls,” Carlos Garcia, a member of the Phoenix City Council, said in a Facebook post. “But, we must all continue to ask for transparency and accountability. We cannot allow for dishonest narratives to be built by violent departments. We will continue to call for independent investigations into officer-involved shootings.”

Garcia’s death comes just weeks after Arizona residents protested the police-involved death of Carlos Igram Lopez in Tucson, and amid nation-wide demonstrations over several other police-related killings.

Yes, his sister knows he was "unarmed sleeping in his car" in the middle of the day when officers yelled and screamed at him, not waking him up. The officers then shot him while he was still sleeping and magically conjured up a gun with witchcraft, waving it for the cameras. BLM is investigating.

 

I had to post this. The absolute most ridiculous statement witnesses are making is that he was sleeping in his car. This is friggin Phoenix AZ in July at 1pm in the afternoon. The vehicle is not in the shade. It’s 110 outside so it’s 160 degrees inside the vehicle. Come to Phoenix in July and try sleeping in your vehicle.

A 911 call was made by one of the residents stating that the “victim” was an aggravated assault suspect from the previous week and has threatened again.

 

What does the forensic evidence say? That is the one thing that can't really lie.

Nah, the leftist movement in Phoenix is not that big, plus it’s 112 out right now. No one in their right mind will protest In this heat. This is also Maryvale, an inner city section of Phoenix that is well known for drug cartel activity. No one gives a crap about that part of town.

It only lasts for several seconds, it takes place after the suooting, and all that I can gather is some idiot cop talking about "glove up".

That vid doesn't really do much to advance the narrative.

Why do the MSM always run to the family and ask them what happened when they weren't even there? I'm sorry for the families but they usually are not there and are certainly not experts in the law. Families have no higher standing than anyone else when it comes to the facts. If this guy wanted justice then he should have cooperated with the police, put his hands up where they could see them and not then pull it on them.

Wow, so I gather that basic investigation is not one of your strong points. You don’t see the two officers still standing in the defensive positions on opposite sides of the vehicle (not directly in the firing line of each other) as the officer is running up on the vehicle? You didn’t see an empty hand retrieve an automatic sidearm from the lap of the deceased? You didn’t hear the victim of the 911 call claiming aggravated assault? “Sleeping” in a vehicle with daytime temps of 110 is not unusual to you?

 

None, the Latinos don’t want any unnecessary attention drawn on them. There’s too many illegals and drug cartels in that area of town.
