    Right. Except it’s logical to conclude that a relaxing of penalties on offenders of sexual molestation of a child is a step towards the decriminalization of the behavior overall.

    That’s the exact path used to decriminalize homosexuality, drugs and nearly every other behavior that’s been classified as criminal and then decriminalized. They start out by reducing penalties on the subset of the group which they believe they can gain some traction for sympathy.

    No. This bill would not decriminalize that. This bill would not decriminalize anything.

    The OP is completely misleading, to the point of lying.

    And how about 21 and 12? If a 21 yo has anal sex with a 12 year old? This bill would state that he does not automatically have to register as a sex offender. Does it not?

    How does giving discretion as opposed to mandatory registration even REMOTELY represent equality in sentencing. Mandatory registration for all is the definition of equality.

    False. From the bill:

    (2) Notwithstanding paragraph (1), a person convicted of a violation of subdivision (b) of Section 286, subdivision (b) of Section 287, or subdivision (h) or (i) of Section 289 shall not be required to register if, at the time of the offense, the person is not more than 10 years older than the minor, as measured from the minor’s date of birth to the person’s date of birth, and the conviction is the only one requiring the person to register. This paragraph does not preclude the court from requiring a person to register pursuant to Section 290.006.

    It is a step towards equality because right now there is a differentiation between sex acts.
    The judge ALREADY has discretion to place a convicted offender on the registry if
    1 the younger person is at least 14
    2 there is no greater than 10 years difference and
    3 the sex act was vaginal sex.

    This bill removes requirement 3, so the discretion also applies if the sex act is different.

    If you read my second post, you'd know I agree, it's garbage, happy? I'd simply not read the link, when the Washington statutory rape law came to mind. Do you think Washington's 16 is consent within a 5 year age difference, otherwise 18 is "reasonable"? (Mind you, having nothing to do with online predation, simple age of consent law.)

    You would also have to look at all those various subsections. I’ll make it easy for you:

    “Currently, for consensual yet illegal sexual relations between a teenager age 14 to 17 and a partner within 10 years of age, “sexual intercourse” (i.e., vaginal intercourse) does not mandate that the offender to go onto the sex offender registry; rather, the judge has discretion to decide, based on the facts of the case, whether sex offender registration is warranted or unwarranted. By contrast, for all other forms of intercourse — specifically, oral and anal intercourse — sex offender registration is mandated under all situations, with no judicial discretion.”

    There is no indication that sexual molestation will be treated any differently than it is today. When the elder of high school sweethearts turns 18, he or she does not become a sexual predator. If a 17 year old girl meets a friend of her older brother, and they hit it off, there's no pedophilia going on. There is no rational reason that such "offenders" need be on a registry. Anyone convicted and sentenced to time will remain on the registry. Others like I mentioned, if they do make it to court, are not punished like those of a true sex offender, and forcing them onto a registry is excessive punishment for the "crime."

    Homosexuality and drug use are consensual activities, just like frat parties and beer guzzling contests. Has nothing to do with slippery slope.

    All cases are unique. Mandatory registration fails to recognize this, so it has nothing to do with equality.

    Consent, in this context, is the weakest defense of them all. It’s illogical, subjective and if that’s the only defense you have, you have no defense.

    For instance. A 15 year old can consent in some states but not others. If the 15 year old crosses state lines into a state that allows 15 year olds to consent do they magically become capable of doing so? If said 15 year old goes back to the state which doesn’t allow, does the 15 year old magically lose the capability to consent again?

    Furthermore, on what grounds do you base the limit for this subjective age of consent? There are some 13 year olds who are far more intellectually advanced and capable of understanding the concept of consent than some 25 year olds. On what grounds should they not be able to consent?

    For the record I’m not stating that’s how I believe it should go but I am stating that’s what the pedophile is going to argue.
    He’s also going to argue, why the subjective age of 10 years? Why not make it 15 years or 20 or 8?

    Not sure what you're talking about. My argument for consensual activity was homosexuality and drug use, as I wrote.

    Sexual maturity is reached at different times by different individuals, and this has nothing to do with intellect. Hormones drive sexual activity. The legal age of consent should reflect this reality. Sex is a biological function, not an advanced legal concept.

    I have no idea what the argument is. It's an obscure law that somebody picked up and decided to politicize. Typical slippery slope-turned-disinformation argument. Pretty unhinged.
