    The U.S. Justice Department is seeking to take over President Trump’s defense in a defamation lawsuit from a writer who has accused him of rape, and federal lawyers asked a court Tuesday to allow a move that could put the American people on the hook for any money she might be awarded.

    After New York state courts turned down Trump’s request to delay E. Jean Carroll’s suit, Justice Department lawyers filed court papers Tuesday aiming to shift the case into federal court and to substitute the U.S. for Trump as the defendant. That would mean the federal government, rather than Trump himself, might have to pay damages if any are awarded.

    The filing complicates, at least for the moment, Carroll’s efforts to get a DNA sample from the president as potential evidence and to have him answer questions under oath.

    Justice Department lawyers argue that Trump was “acting within the scope of his office” when he denied Carroll’s allegations, made last year, that he raped her in a New York luxury department store in the mid-1990s. She says his comments — including that she was “totally lying” to sell a memoir — besmirched her character and harmed her career.

    So let's see how this looks. A woman who has accused Trump of raping her in the 90's in a department store dressing room in New York is going to sue Trump as Trump uses the United States Department of Justice to fight her in court. Hmm, yeah that sounds like democracy, doesn't it? Nope-to-defend-trump-in-rape-accusers-defamation-lawsuit

    Wow, this lady is a complete nut bag. Justice Dept. wants to intervene because she is acting to attack the POTUS. I have a sneaking suspicion they are going to make a nasty example of her.

    Lawyers for the Justice Department said in court papers that Mr. Trump was acting in his official capacity as president when he denied ever knowing Ms. Carroll and thus could be defended in court by government lawyers — in effect underwritten by taxpayer money. Citing a law called the Federal Tort Claims Act, the department lawyers asserted the right to take the case from Mr. Trump’s private lawyers and move the matter from state court to federal court. The law gives employees of the federal government immunity from lawsuits, though legal experts said that it has rarely, if ever, been used before to protect a president.

    One problem, she has 'the dress'. In a trial he may be obliged to submit a DNA sample. (oops)

    As part of the suit, Carroll is now seeking a DNA sample to compare with DNA from skin cells found on a dress that Carroll says she was wearing when the assault occurred. “Unidentified male DNA on the dress could prove that Donald Trump not only knows who I am, but also that he violently assaulted me in a dressing room at Bergdorf Goodman and then defamed me by lying about it and impugning my character,”

    Why the hell should U.S.Taxpayers be on the hook for anything Dirty Donald ever did??? It's bad enough we have him grossly mismanaging our country. There is no way we should ever be stuck paying for his sins.

    I don't know who is worse Trump or Barr. What I DO know is the combination is terrible for the country.

    So, you know these accusations are probably BS.

    We saw what happened during the Kavanaugh confirmation.


    If I thought there was even a 10% chance this woman's story might be credible, I might be the slightest bit perturbed by this.

    I read her story years ago. She's a journalist used to write for SNL and had a big job as a columnist for Elle magazine for many years until Trump smeared her publicly and she lost her job at Elle. She's the 16th woman to accuse Trump of sexual misconduct, it's not like she's the first as with Kavanaugh.

    No, you're not being honest. There's no way in Hell that you would take any accusation against Trump by anyone as 'credible'.

    This isn’t about whether the woman’s story is credible. It is about whether the DOJ should defethe président for things he said and did in his personal capacity.

    It’s outrageous but at this point no longer shocking.

    Rubbish. Fair bloody dinkum. If Trump tales a crap, is that him acting in his official capacity as POTUS? Of course not. So, NightOwl, given you are pushing this barrow, show me where making a denial of sexual assault has anything to do with the official capacity of POTUS.

    Team USA, this is the very sort of tomfuqqery which gives the USA and its system of justice a very bad reputation. Utter garbage, but, if you lot want to pay for Trump to fight his personal litigious battles, go for it. But, call it what is is....corruption, and get on with it.

    I think it reflects very badly on AG Barr and on Trump. I wouldn’t condemn the justice system (over this) unless the court rules in favor of trump.

    So Trump had sexual misconduct against 16 women and not one of them came forward before he became President?

    Also she's a writer for a magazine, so what are the chances of that?
    That just makes it less credible.

    Next up if he get's this. "I, as president, deny any accusation that the fraud and tax evasions uncovered or that may be uncovered in the future were my fault."
    • Lawyers paid for.
    • Any fines or penalties paid for by the government.

    I find the bit about Trump acting in his role as president. Just what exactly does denying sexually assaulting this woman and then defaming her character have to do with his job?
    Next thing you know this scene will play out at the White House.
    White House Plumber "Mr. President, why do you want these modifications to your toilet?"
    Trump "Because that's presidential merde, produced by the president in performing his morning duties as president. It belongs in the National Archives."

    Why should trumps guilt or innocence have anything to do with the the abuse of the DOJ?
    Plus what makes you so sure of his innocence especially given his past behaviors? Add to that she has the dress that could contain his DNA and trump is on record saying he doesnt know her then when pics surfaced it shifted to maybe I met her once or twice.
    There is zero reason to believe trump on anything he says I would probably believe the devil himself over trump.
