    A LAYMAN'S PERSPECTIVE
PREFACE: Again, I apologize for the poor response time. I was overtaken by local events.

BLUF: I acknowledge your use of the term "ethnic cleansing" rather than "genocide" and I think I understand why. For many people, the term "ethnic cleansing" does NOT imply mass murder in the same way that the term "genocide" is associated with the systemic eradication of a segment of the population. But from a more expert view, there

    (COMMENT)

Having said that (in the BLUF) it is important to pass-on the nature of the conflict in your usage.
I have bolded three areas of the presentation. If you were a Counterintelligence/Counter-Terrorism Agent, you would have a very hard time bringing charged before a prosecutor for the "Ethnic Cleansing." The general Rule of Law is:

    (BOTTOM LINE)

On the international level, there is a very good argument to be made that there is no specific crime of Ethnic Cleansing because the meaning of Ethnic Cleansing is "Undefined."

You also mentioned, "“Plan Dalet”" • However it was assembled, it is commonly agreed that it dates back to a time before the establishment of Israel and after the Arabs of Palestine made a solemn declaration before the United Nations, before God and history, that they will never submit or yield to any power going to Palestine to enforce partition. The only way to establish partition is first to wipe them out — man, woman and child.

However, the concepts of Rome Statutes until 17 July 1998, in force on 1 July 2002, and the statutes cannot be retroactively applied... (Article 24, Rome Statutes, ICC)

I hope this explains where I am coming from, simply as a layman.

A real God would never hate a child, Esau, nor would he allow the murder of all the innocent boy babies. Some deranged mind made these stories up, I'm sure.
God has put in place the law of Karma = every action causes a reaction. Christ even said that we will reap what we sow. He has also given us the Golden Rule to live by. If we would only listen and live accordingly, life on earth would be a lot more pleasanter. We can not escape our lessons. We ourselves create our Karma and will have to go through many lives in order to refine ourselves.

Please don't feel a need to apologize for responding as time permits. I view participation in this well run forum as a means of enjoyable recreation and thoroughly enjoy being able to exchange opinions and ideas with people around the world. I am here to learn as much as I am here to express my views and I appreciate your pointing out the rulings of various international bodies.

If I understand you correctly, you are asserting that the current and previous Israeli governments as well as previous Zionist terrorist gangs are guilty of neither genocide nor ethnic cleansing in spite of their being guilty of the following practices as well as others not listed:
"...murder, torture, arbitrary arrest and detention, extrajudicial executions, rape and sexual assaults, severe physical injury to civilians, confinement of civilian population in ghetto areas, forcible removal, displacement and deportation of civilian population, deliberate military attacks or threats of attacks on civilians and civilian areas, use of civilians as human shields, destruction of property, robbery of personal property, attacks on hospitals, medical personnel, and locations with the Red Cross/Red Crescent emblem, among others." (From your source)

If the Israeli government as well as the murderous Settlers it aids and abets is responsible for the crimes listed and you feel that neither "Genocide" nor "Ethnic Cleansing" are appropriate labels, what would you consider an appropriate label for the crimes committed by Israel and its murderous gang of state supported land thieves?

Over the decades I have discussed the Israel - Palestinian conflict, I have noticed a tendency among those who attempt to justify or excuse Israeli/Zionist crimes to overcomplicate what is in reality a straightforward affair.

The overwhelming majority of Palestine had been for centuries been predominately Arabic with Jews comprising 3% - 4% of the region's population until 1880. Until the invasion of foreign, Zionist terrorist gangs from the West, Jews and Arabs got along reasonably well(1).

The invasion of Western supported Zionist terrorists changed all that when they came from afar armed with self serving myths of an ancient "Jewish homeland" and a "Greater Israel" when the invading Ashkenazi terrorists were in no way related to the Ancient Hebrews / Israelites of Biblical lore.

While the savagery of these Zionist terrorist gangs is grossly under-reported in most Western history books even less is known about the collusion between Zionists and Germany's National Socialists in their joint quest for a racially pure homeland.

This frequently seen map shows more than 1,000 words can tell about the extermination and expulsion of Palestine's native residents:

Can you blame Palestine's native residents for resisting what I frequently call the longest & most ruthless, foreign funded Occupation in modern history?

Although Arabs were a majority in Palestine prior to the creation of the state of Israel, there had always been a Jewish population, as well. For the most part, Jewish Palestinians got along with their Arab neighbors. This began to change with the onset of the Zionist movement, because the Zionists rejected the right of the Palestinians to self-determination and wanted Palestine for their own, to create a “Jewish State” in a region where Arabs were the majority and owned most of the land.

The British Hope-Simpson report of 1930 similarly noted that Jewish residents of non-Zionist communities in Palestine enjoyed friendship with their Arab neighbors. “It is quite a common sight to see an Arab sitting in the verandah of a Jewish house”, the report noted. “The position is entirely different in the Zionist colonies."CONTINUED

The flag that would one day be adopted by Israel was flown at the Zionist camps and centers in Hitler's Germany. /19

Himmler's security service cooperated with the Haganah, the Zionist underground military organization in Palestine. The SS agency paid Haganah official Feivel Polkes for information about the situation in Palestine and for help in directing Jewish emigration to that country. Meanwhile, the Haganah was kept well informed about German plans by a spy it managed to plant in the Berlin headquarters of the SS. Haganah-SS collaboration even included secret deliveries of German weapons to Jewish settlers for use in clashes with Palestinian Arabs."CONTINUED

BEWARE of so-called "history" written by the evil Edomite-jew winners of WW2!

In his autobiography [Mein Kampf] Hitler repeatedly condemns Jews as evil and perverted. Hitler also said if Zionist Jews ever did take over Palestine they would turn it into an evil haven for international criminals and thieves !!

I think that it is naive, at least, to believe that only the "other" side used propaganda.
Of course since "history" is written by the victors, it is going to include the same propaganda promoted by the victors.
U.S. propaganda was handled by the OWI (Office of War Information) which worked very closely with Hollywood to produce shocking and inaccurate "documentaries" and entertaining but fraudulent war movies to this day.

As far as Israel becoming: "...an evil haven for international criminals and thieves !!", I think that the following quote is noteworthy:

"Israel may have the right to put others on trial, but certainly no one has the right to put the Jewish people and the State of Israel on trial."

PREFACE: From the standpoint of closing a cultural divide, I think we are much closer than you might first think. Our individual perceptions and delimitation divides our societal norms in our familiar segments of societal norms are not that different relative to commercial and economic structures, expectations for advancement from one generation to the next, and even our
manners of communications, as evidenced by our participation in this discussion group, are NOT so different → that they represent an impenetrable barrier between the appreciation of the other perspective [associative points-of-view (POV)]

BLUF: The way you have presented your objects is simply too overwhelming for me. In order to break this entangled view down, I would have to write a small encyclopedia. Instead, I will focus on a few items, and you are welcome to redirect the course of the discussion as you will. (This is not meant to be argumentative, but merely a statement of fact on my limitations.)

    (COMMENT)

The implication in the statement" "Zionist terrorist gangs:" I content that a "Zionist" is (in thumbnail view) a national movement of Jewish self-determination. Zionism is not terrorism and is not racist.

◈ Leading up to the actual Declaration of Independence of Israel, there was the National Council for the Jewish State (NCJS) which represented the various Jewish bodies in the territory to which the Mandate applied, and established as an independent and sovereign state → Israel. This was the political action arm that implemented Jewish self-determination. In 1948, the idea and concept of "self-determination" were murky and elusive. While the term "self-determination" was used in the UN Charter [Article 1(2)] it was not really defined. In contemporary times the "right" is addressed in three distinct forms (The UN Charter, The International Covenant on Economic, Social and Cultural Rights, The International Covenant on Civil and Political Rights).

    ✦ To develop friendly relations among nations based on respect for the principle of equal rights and self-determination of peoples, and to take other appropriate measures to strengthen universal peace;

✦ All peoples have the right of self-determination. By virtue of that right, they freely determine their political status and freely pursue their economic, social and cultural development.

◈ In contemporary times, there is no definition of a terrorist. It is a subjective call, and they are identified by their proper name or by a specific action. And similarly, a terrorist organization is identified by its actions. (example: EU COUNCIL DECISION (CFSP) 2019/25)

✦ The process on pinning-down terrorism began in 1938 and the Convention for the Prevention and Punishment of Terrorism (1938). And again, the ideas were driven by the actions, and not personalities: "acts of terrorism" means "criminal acts" directed against a state, intended or calculated to create "terror" in the minds of the citizenry and general public.

✦ In the 21st Century, the International Community has some 19 CT International Legal Instruments (1963 - 2005 CONVENTIONS) covering various sets of terrorist actions.

However, relative to Occupations (like that in the Israel-Palestine Conflict) the most applicable Customary and International Humanitarian Law (IHL) is Article 68, Fourth Geneva Convention:

Protected persons who commit an offence which is solely intended to harm the Occupying Power, but which does not constitute an attempt on the life or limb of members of the occupying forces or administration, nor a grave collective danger, nor seriously damage the property of the occupying forces or administration or the installations used by them, shall be liable to internment or simple imprisonment, provided the duration of such internment or imprisonment is proportionate to the offence committed. Furthermore, internment or imprisonment shall, for such offences, be the only measure adopted for depriving protected persons of liberty. The courts provided for under Article 66 [ Link ] of the present Convention may at their discretion convert a sentence of imprisonment to one of internment for the same period.
The penal provisions promulgated by the Occupying Power in accordance with Articles 64 [ Link ] and 65 [ Link ] may impose the death penalty on a protected person only in cases where the person is guilty of espionage, of serious acts of sabotage against the military installations of the Occupying Power or of intentional offences which have caused the death of one or more persons, provided that such offences were punishable by death under the law of the occupied territory in force before the occupation began.
The death penalty may not be pronounced against a protected person unless the attention of the court has been particularly called to the fact that since the accused is not a national of the Occupying Power, he is not bound to it by any duty of allegiance.
In any case, the death penalty may not be pronounced against a protected person who was under eighteen years of age at the time of the offence.
Having said all that, in the era of Post-Declaration of Independence (more than a half-century back in time) are their such things as Zionist Terrorist Gangs? (RHETORICAL) NO!

Almost every major power in the world has had, what we would call today, a terrorist legacy; even America. Now, have some incidents from that laundry list of crimes you present occurred since the establishment of the State of Israel? (RHETORICAL) Some quite possibly! But the days of the Irgun and Stern Gang have long since receded into the annuls of history. But in any conflict of any measure of savagery and in some significant period of time, some seven-decades in duration, there are bound to be such incidents that need a local investigation to determine the facts.

    (COMMENT)

The legality of the establishment of settlements (Area "C"), subject to the Permanent Status of Negotiations, Article V • Declaration of Principles on Interim Self-Government in Oslo I, which the Arab Palestinians agreed on, have not been discussed in negotiations or the subject to Article XV • Resolution of Disputes, is a question.

    (COMMENT)

Well, nothing involving fraud, theft, misfeasance/malfeasance under the color of authority, is simple or straightforward. Most people have not connected the dots on the way aspects of the conflict are evolving. Most of the issues could have been resolved by now if the parties to the Oslo Accords had exercised the Article V or Article XV process, which are the off-shoots of the Declaration on Principles of International Law concerning Friendly Relations and Co-operation among States (1970) A/RES/25/2625.

Every State shall settle its international disputes with other States by peaceful means in such a manner that international peace and security and justice are not endangered.

States shall accordingly seek early and just settlement of their international disputes by negotiation, inquiry, mediation, conciliation, arbitration, judicial settlement, resort to regional agencies or arrangements or other peaceful means of their choice. In seeking such a settlement the parties shall agree upon such peaceful means as may be appropriate to the circumstances and nature of the dispute.

    (COMMENT)

On the HMS Agamemnon the Mudros Armistice was signed - that end of the Great War with the Ottoman Empire on 31 October 1918. Occupied Enemy Territory Administration (OETA), which had been established in 1917 moved forward.

"The San Remo Conference the Principle Allied Powers decided on April 24, 1920 to assign the Mandate [for Palestine] under the League of Nations to Britain. The terms of the Mandate were also discussed with the United States which was not a member of the League. An agreed text was confirmed by the Council of the League of Nations on July 24, 1922, and it came into operation in September 1923."

After the Armistice of Mudros, the Arab Palestinians had no sovereign claim anywhere in the region.

    (COMMENT)

I'm a bit confused here. Anything prior to the San Remo Conference and the establishment of the Mandate is totally irrelevant. And much of the political wrangling during the period of the Mandate of the territory was overtaken by events after May 1948.

It is my opinion, that the solution to the Israeli-Palestinian Conflict rests with developing strategies with what is available today. Much of the history must be wiped clean to engage in new regional peace.

That's a good idea, and if the Israelis have any humanity in them, they, too, would agree. Apparently, the Palestinians themselves came up with a new idea...

"The sheer size of the settlements on the West Bank, home to more than 650,000 Jews, rules out the possibility of a viable, territorially contiguous Palestinian state. Consequently, there is growing support on the Palestinian side, though not on the part of the Palestinian Authority, for the idea of one democratic state between the Jordan River and the Mediterranean Sea with equal rights for all its citizens."

    https://foreignpolicy.com/2020/12/2...alestinian-peace-he-must-break-with-the-past/
That would cut through all the dead and degrading stuff of the previous decades.

Do you, Rocco, believe the Jews will go for it? Would you advise them to try it?
What could they lose by agreeing, beside their snub-nosed pride?
I am skeptical they'll be able to overcome their hatred for the Pals and will still indulge in bombing and bulldozing them. Ingrained habits are hard to overcome!
    But it's worth a try!!

Before I respond to this most recent comment, there are 2 questions I asked in my previous comment you may not have noticed.

The first one was: "If the Israeli government as well as the murderous Settlers it aids and abets is responsible for the crimes listed and you feel that neither "Genocide" nor "Ethnic Cleansing" are appropriate labels, what would you consider an appropriate label for the crimes committed by Israel and its murderous gang of state supported land thieves?"

I assume you are aware that ethical, former IDF members of BtS ("Breaking the Silence") have had the courage and integrity to speak up about atrocities committed by both IDF members and militant Settler extremists whose crimes IDF members either assist in or ignore.

Another question I have frequently posed is: "Can you name any brutally occupied people who have not resisted their occupation?"

After reading and re-reading your comment, I sense a sort of contradiction. On one hand you list various Western agreements, declarations and decisions that attempt to exonerate Israel's occupation and negate Palestinian claims to a state:
    .

However, on the other hand, you feel that:
Am I correct in interpreting that you feel that Palestine's native residents should simply forget and forgive their enormous loss of life and property over a period of decades and accept a life of cramped squalor and humiliating persecution?

Before the Holocaust Industry began extracting countless $ Billions from various nations and entities around the world, how do you think this same sort of wiping clean of history would have been received by its army of fraudulent & insatiable extortionists(1), (2)?

Finally, your knowledge of Western international law, agreements and conferences is impressive however to the native residents that are affected by their rulings, it's just the same plundering Western, Colonial powers drawing lines in the sand while always under the influence of powerful Zionist political organizations.

Among the things I learned during my 10 - 11 months living among the Muslims of that troubled region is that they have long memories and are not likely to be receptive to a new regional peace unless old Colonial/Zionist abuses are addressed.

BLUF: There is a bit of a political anger issue between the belligerent, no question. And while the anger is receding between each successive generation in Israel, the same cannot be said for the Palestinians. The anger is increasing with every new generation of Arab Palestinians. This is placed an ugly footprint on the negotiation carpet.

    (COMMENT)

There is a storm cloud rolling in over the other issues that may poison productive table talks. The Arab Palestinians have been rather successful in the legal wrangling at the International Criminal Court (ICC). While notoriously slow, the ICC Investigation May aggravate the process; constantly scratching the scab.

    (COMMENT)

I would certainly (if in the position) do some political exploratory work.

    (COMMENT)

While the Israelis are proud people, I don't think that their pride will have much of an adverse impact. What will annoy the Israelis is if the Arab Palestinians demand a halt to settlements as a precondition to peace talks. Politically, the whole point of settlements and settlement expansion is to pressure the Arab Palestinians to the peace table. It is a serious Political Bargaining chip.

    (COMMENT)

Well, I don't think the IDF Air Force has had a bombing sorta in the West Bank or Jerusalem in over 20 years. While they do destroy houses under the Annex to A/RES/60/288 (UN Plan of Action • Section II Measure to Prevent and Combat Terrorism • Para 2. • To cooperate fully in the fight against terrorism, in accordance with our obligations under international law, in order to find, deny safe haven...) and sometimes appropriate property under the concept of emanate domain, major crimes are not a matter of policy or all that frequent.

As a sidebar, (even though I personally believe that the ICC is investigation amounts to misfeasance and malfeasance under the false color of authority) → Hamas and Palestinian armed groups (“PAGs”) are under investigation for war crimes of: intentionally directing attacks against civilians and civilian objects (articles 8(2)(b)(i)-(ii), or 8(2)(e)(i)); using protected persons as shields (article 8(2)(b)(xxiii)); wilfully depriving protected persons of the rights of fair and regular trial (articles 8(2)(a)(vi) or 8(2)(c)(iv)) and wilful killing (articles 8(2)(a)(i), or 8(2)(c)(i)); and torture or inhuman treatment (article 8(2)(a)(ii), or 8(2)(c)(i)) and/or outrages upon personal dignity (articles 8(2)(b)(xxi), or 8(2)(c)(ii)). WHEREAS members of the Israel Defense Forces (“IDF”) committed the war crimes of: intentionally launching disproportionate attacks in relation to at least three incidents which the Office has focussed on (article 8(2)(b)(iv)); wilful killing and wilfully causing serious injury to body or health (articles 8(2)(a)(i) and 8(2)(a)(iii), or article 8(2)(c)(i)); and intentionally directing an attack against objects or persons using the distinctive emblems of the Geneva Conventions (article 8(2)(b)(xxiv), or 8(2)(e)(ii)).

Counter-Rocket and Mortar (C-RAM) fire directed at fresh launch sites are potentially dangerous to civilians, there is generally a concrete military advantage anticipated.

    (Ω)

I believe if the Arab Palestinians make a good faith effort to seek early and just settlement of their disputes, I believe that the Israelis will respond in kind.

That's an interesting response and can only come from someone firmly supporting the Israeli side. Saying there hasn't been a bombing of the West Bank and Jerusalem, that may be true, because that's exactly where the Israelis live!!! What about the Gaza Strip? Aren't the Pals living there as well? Just this past Christmas the Israelis bombed peoples houses, a hospital, rehabilitation center, a Moshe etc.

Dear Rocco, where do the Pals get these "thousands" of rockets from? They can barely feed themselves, because even the little donations they get here and there have often been held back or taken away by the Israelis...-->

General Pershing and the Mexican Expedition mean nothing to me! If he is your hero, because he beat the Mexicans to pulp, so be it!

I grew up in Germany and know a little bit about WWII.
At the time, Hitler was our hero, and he, like Pershing, defeated the Poles, who were busy killing thousands of ethnic Germans without provocation. But to this day no monument has been built in his honor!
It all depends on who you are, either the winner or loser. The winner is always right and gets to write the history! That is very obvious for Germany. We lost and have to hate and despise our heroes as the utmost evil on earth!
Israel and the USA won and are automatic the glorified saviors who can do no wrong!!

Why do you say, the international media has worked tirelessly to ensure that the Israelis are set in a situation where they are not permitted to attain a decisive victory?
To my knowledge, the media is Jewish and has all the power it wants to write what it wants... mostly in favor of Israel or Jewish affairs.
Maybe you could explain that to me?
    Thanks.
