    I don't believe someone else hasn't posted this, yet. It is a very interesting hearing. The Justices presumed to be hostile to Roe-- Clarence Thomas, Alito, Amy Coney Barrett, Kavanaugh, Roberts, etc.-- seem very well prepared; they are putting those arguing against Mississippi's law through a real gauntlet. But the first council I listened to, Julie Rikelman, was impressive in her preparedness, as well, putting forth even stronger arguments, without missing a beat, rebutting any suggestions that could favor the Court's allowing Mississippi, and all states, to decide on abortion, for themselves.

    Thanks for creating this thread. Someone may have posted this elsewhere, as this site's sub forums often bury huge events like this one.

    To me... the Republicans (leadership) are morons. They have the 2022 and 2024 elections nearly locked up and they choose to do this? This is about one of the few things they could have done to screw themselves and here we are. We could end up with another 2-6 years of insane woke, CV-19, economic retardation thanks to the Republicans doing this now.

    This is why extremists should not control a major political party and should not be allowed to pack the Supreme Court as they have done. For shame.

    I heard some of Rikelman's responses. She certainly did her best. Unfortunately any of these arguments of hers, may end up needing to be more persuasive at the state level after this SCOTUS decision is reached than on this court. I don't think anyone in this room is waiting to be persuaded. Either the votes are there, or they are not.

    The court's not packed. You can live under a conservative majority just as we've lived under a liberal majority for most of our waking lifetime(if we're 30 or younger.) The idea that conservatives could not have a ruling in their favor in this country is why SCOTUS is fundamentally broken. The State's affair cannot be decided by the Court.

    How did Republicans "pack" the Supreme Court? Democrats ruined America by legislating from the bench for 60 years. Suddenly the Court is "too political" when you are no longer in the majority and fear you won't get your way?

    It's funny how the Supreme Court has been conservative dominated for decades, even though the GOP has won the popular vote for president only once in almost 30 years. It's another aspect of the GOP minority rule, which is manifested in the Senate. It's blatant disenfranchisement of Dem voters, and now they are working on getting a permanent GOP minority rule stranglehold on the House too. Of course, Republicans see nothing wrong with it. If the shoe were only on the other foot....

    Right when it seems republicans are starting to pull ahead politically, they choose to pursue an idiotic cause like this. Lunatic extremists are alive and well in both parties it seems.

    It's not who they were appointed by, its the ideology of the Justices that matter and you can't mean to tell me the Democrats wouldn't have prioritized the SCOTUS as they have if we did not previously enjoy a Liberal SCOTUS. Has the contributions of Kagan, etc already lost their merit in the eyes of progressives?

    You calling them "extremists" is really sad. They value the child's life. For you to go that hard on them makes you look like the extremist.

    I find abortion abhorrent, disgusting, and wrong for a vast majority of the instances it happens, but I am not going to tell a woman what she can and cannot do with her body. She will have to answer to her maker for her decisions and it's way above my pay grade on how that works out.

    Exactly how I feel Surfer.

    I'm conservative and pro-choice, but within limits like the first trimester. The push for further late term abortions is disgusting.

    But it's very telling that when conservatives hold opinions like me and you, we are labeled extreme. Pretty easy to see where the actual extremism exists.

    Looks like it will (ultimately) come down to Kavanaugh:

    Brett Kavanaugh, however, noted that even if the issue were returned to the states, abortion would still be available in some of those states. He conceded that supporters of abortion rights have a "forceful argument" but asked if there were two interests at stake, why the court should be the arbiter.
    The court's other four conservatives were clearly critical of 1973's Roe v. Wade and 1992's Planned Parenthood v. Casey, which enshrined the right to abortions nationwide. Sixty percent of Americans say Roe should be upheld, according to an ABC News/Washington Post poll conducted in November.

    That all makes a lot of sense to me, but, abortion regulations are about what the woman can do about her baby's body, when she can do it, and how those rules are fashioned in our representative democracy.

    If we want a national standard rather than a State by State standard the majority agreed on, then Congress should pass it and the President sign it. If we have no such standard then the laws of the State legislature should be respected in my view, however, that is not how I expect this case to shake out.

    We have a 3-3-3 Court. I suspect 3 votes will be for further extricating the Court from the position it should have left for Congress, 3 votes for maintaining it, and 3 votes that will be for preserving the doctrines already established by the Court. The Court already affirmed most of Roe in Casey, and what they affirmed, in my mind, would make it very difficult for the middle 3 to allow the 15 week ban.

    Some facts that important from a human perspective but which I don't expect to carry the day:

    And Kavanaugh, with his deference to precedent?

    I don't think so, and while it will be interesting to see where Barrett comes down on this, I don't see Roe getting overturned.

    Just some context here. If the SCOTUS go with the idea that they as a group have no ability to create a legal right absent any foundation in the constitution, it would not immediately outlaw abortion. Far from it. It would simply put the onus on the legislators of the states to set conditions that represent the will of their citizens. Like every other non iterated function in constitutional framework.

    There are a couple lines here. Viability, Consensus. all legitimate benchmarks in legislative intent when crafting a law. It looks like there are at least 5 votes here. Possibly 6 if Roberts can craft a viability standard. Time will tell.

    There's nothing "extreme" about banning elective abortions after 15 weeks. France bans elective abortions after 12 weeks (source). Do you generally consider French women to be oppressed by an evil theocracy?

    I'm conservative and generally pro abortion - even pro federally funded abortion. However, I hate seeing my country destroyed by liberal judges and am willing to sacrifice some of my preferences on abortion in return for a better country. That is the equation here. Liberals fear monger "ABORTION! ABORTION! ABORTION!" in order to pack the court with liberals who while never ruling on abortion decimate our borders and make it possible to bankrupt our country to the benefit of illegals and tilt the scales towards violent criminals.
