    It is a foundational aspect of the SC to apply the constitution to today's concerns. Republican Justices have stood by this strongly.

    It is at least somewhat in question that the SC can simply overturn a part of our constitution.

    Besides, the 14th amendment section 3 PRECISELY addresses the problem we face today.

    It would be an ASTOUNDINGLY partisan move for the SC to abandon its foundational standards in order to protect Trump.

    I'm not happy about this direction. The idea of having a president who has repeatedly worked to defeat democracy including ways that are both violent and criminal, who has repeatedly stated a preference for dictatorship is something that is seriously dangerous to America's future. Those in the post civil war era learned how serious this is and expressed that as amending our constitution as a protection for America's future.

    On the other hand, it is a foundation of democracy that citizens are not excluded - EVEN if our forebears were so soundly convinced to the contrary.

    Section 3 doesn't give any 'process', that's pretty much left up to states and their respective constitutions.

    In fact, Section 3 only requires "aid or comfort". There is no requirement for a conviction.

    I heard that just a little while ago. Thanks for posting it. Now , we will see what other items like this will start popping up. Will the MAGA gang keep on believing his lies and supporting blindly?? No matter what they find out. Will they just continue to DENY EALITY??

    I see your response here as a bit hysterical, my right honorable DFT supporter. Being excluded from eligibility to hold the office of the Potus equates to hanging someone in your opinion? Furthermore, I see your choice of this particular analogy ripe with projection, as it is DFT that has the backing of those who would actually lynch someone. It is members of the set to which you apparently belong that called for hanging Mike Pence, yes? or no? I hope you will translate this properly: Good For You.

    Insurrection to the constitution isn't rare at all. I think you may be hard pressed to find a recent President who hasn't done that.

    Of course, the office of the President of the US isn't covered by section 3, so it's a moot point.

    I doubt there are a lot of foreigners who are well versed in the US constitution. Just because you saw someone plead the fifth on Law & Order doesn't mean you have a grasp of the US Constitution. It's hard enough for Americans, at least based on this (and many other) threads. So they can show a grasp of the subject matter before I feel a need to take them seriously.

    Being authoritarian, intolerant, and oppressive is not limited to the "right wing". Calling it such is nothing more than propaganda spread by people who do not want to admit their own failings. Remember, such people think that they are "in the right". Whether they are or not. Such can come from any political spectrum. Even those that think that they are "progressive".

    BTW, being "anti-communist" used to be a progressive ideology. Mainly because communism has always ended up taking away peoples freedoms and became oppressive. Even when it started out "good". So people wanted to get away from that "old way of thinking". Unfortunately...it appears that history really does repeat itself.

    No, the 10th Amendment does not apply here. Because we're talking about a crime.

    Yes, it is being treated as one. The only reason that he is being "disqualified" is due to the claim that he engaged in an insurrection. A crime. Being disqualified due to a claim of a crime is holding him accountable for that crime. Just because he is not thrown in jail does not mean he isn't being held accountable for that crime. Just because he keeps his life does not mean he is not being held accountable for that crime. The 5th Amendment strictly forbids holding someone accountable for a crime "unless on a presentment or indictment of a Grand Jury". This HAS NOT happened. A judge is not a Grand Jury. No matter how you slice it.

    You can't get more contextualist than "No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury".

    Not any of the sect that I belong too. This is not about Trump, but about four activist judges on a court that are keeping a candidate for office off a ballot who has not been convicted of any crime that authorizes such action. I will feel the same way if any Red State does the same to Biden or third-party candidate.

    Why? Because his name is on a flag? I could post pictures of people with flags of BLM but not all of them would be guilty of rioting or trashing buildings. In every demonstration or protest you always run the risk of a few that will try a turn it into a riot.

    Sadly, you have a virtually inverted perception. This is what's being promoted by the left- but.... it's bullshit. A snowjob. A manipulation of your thinking, an abandonment of values.
    You have been deceived by an ongoing attempt to manipulate and use you- done by people without honor at any level.

    If Trump actually did call for an "insurrection", I'd have been in favor of conviction and imprisonment- but he didn't do that. The man has been under unscrupulous attack since the day he announced he would run. The left has been running the equivalent of a mafia vendetta to destroy him- but has never been willing to confront him in the American way, fair play- cards on the table. You can expect reasonable, honorable people to buy the trash the left has thrown at Trump to smear him- all that does is demonstrate that the people behind that have no standards of moral compass.

    The mentality is like that of small spoiled children thinking that denial hides truth and shouldn't taint their lies.

    There are standards of conduct that define honorable people, and unless you have none, you know that they apply to everyone equally. If someone starts tilting the scales of justice, the implications of public news to serve as a weapon instead of openly sticking to the facts- The first thing you should see is the nature of that attack, which immediatly tells you it comes from people totally without integrity, and you should discount anything they say because of the way they attempt to distort the evidence. It destroys their credibiliity, makes everything they do or claim suspect and as such requires reliable independent facts before it warrants consideration. You can't just make up crap and get people of character to buy it. Fools will, the gullible will, the immature and the people lacking self-respect and morals will. But honorable people will not, and they will recognize the absence of character in those who do it.

    What people say- is hot air. What people do, however- is a direct function of who they are. I ignore the words.... I carefully watch what they do, and let that speak for them. When your passions and emotions, your cultivated hate over-ride your self respect- you have neither self-respect nor honor, and while such people vehemently deny that in the light of day- alone in the dark of night, they know it's true. Once you have discarded respect for yourself, you have nothing to lose, so it continues- but there is no redemption in that. To me, it's very sad that there are so many people who have been manipulated into the position that they are willing to distort the truth and buy the lies in order to tell themselves they have some kind of power. They destroy themselves and I find that very sad- but because they are doing it to themselves, I have no sympathy for them.

    If you want to say you don't like Trump, or you think he is sometimes arrogant or as one friend of mine always said she didn't like his hairdo- at least that's honest. But the question isn't about that, it's about competence in getting the job done. Biden has botched everything he's addressed, he has messed with things that should be left alone, and ignored things screaming for attention. This is incompetence that is worse than having nobody in the office at all- and if you don't see that, you have absolutely zero ability to appraise the qualities that Trump brings to the table. Trump has his faults, and we all know that- but unless you are an idiot, you don't elect someone because you like their personality, you elect them because you believe they will do the best job. As Joe lacks anything that could be called a personality and certainly lacks anything that qualifies as competence, one can only assume that a vote for Biden is a vote against Trump- and sadly, against yourself. No reasonable, thinking person does that. I'm not ready to believe that the American people have become that gullible.

    I'm an advocate for strong people. Not just some, but all people. This takes the will to get your butt in the drivers seat and run your own life and your own thiniking. People need solid identity, respect for themselves and good values, including those that self-regulate, where they know they have no right to diminish the rights of their fellow man, and don't. These are the people who can build great nations and societies. As a general rule- conservative people tend to follow that philosophy; it's the way that a society can thrive despite differences of opinions and personalities. At the same time, such a person must oppose efforts to diminish other people, he must recognize thier rights to be strong, to be independent. He must not support efforts to make others weak and gullible, unable to think for themselves... make them dependent people. Why would anyone want to do that? Because if you are weak, you won't resist, you won't think or protest- you will comply, and can be easily baited into doing this no honorable person would do. In other words- you can be controlled like sheep in a herd. If you took notice of what's happened in our new media over recent years, you see the sheep-herding going on everyday. Truth is no longer respected or protected- it is abhorred by those who cultivate your weakness.

    Perhaps you don't mind that. Perhaps you can no longer see that. Perhaps- you see having a double standard of right and wrong that protects the side you think cares about you is justice.

    I don't fear strong people- because I am a strong person. Strength intimidates those without honor- even though it poses no real threat. Trump intimidates the left, but it's not the man, it's the threat to the illusion they present of themselves that makes them fear him. IF we have another candidate in the coming election with similar philosophies to Trump, similar strength and commitment, I may vote for that person just to disable the ability of the left to keep trashing Trump as a person- while they actually want to defeat his values; destroy the message by killing the messenger. It won't work, but they don't understand that.
    Another messenger will step up, carrying the same message, the same strength and courage- and that is the person who gets my vote. Trump is temporary. What has to win- is America, the values, the strength, the honor- the dream that inspired the world.

    It's really sad that you do not seem to grasp the big picture and see that, to feel fortunate to be part of this nation.
