The Death Penalty is different. In Romans, God gave authority and power over the sword to the civil authority. That means everything from the ticket book all the way to the execution chamber. And, you forget that national defense IS the only government sanctioned role according to the US Constitution. Simple as that. the unborn are totally innocent. Why should they be sentenced to death?
