That so many of their appointments are for life is a two edged sword. They can be independent, which is the design or they can be very partisan, which is the hope of those who get the opportunity to appoint them. Basically we are stuck with whatever.
Meaning that if the DOJ has already read and processed a document they should not have, it does no god then for a judge or special master to assert they cannot use that document.

And that's a problem why? In a country where there's a 94% plea rate, we have to acknowledge some things are wrong with the current criminal justice system and among the biggest that's become apparent is the DOJ-Judiciary alliance. If everyone had an independent counsel to review and sequester documents/items which may be evidence and which isn't, that assures equal fairness for all witnesses.
It's not that the government can't overcome this burden, it's that it doesn't want to.
How many of Trump's lawyers have been disbarred or sanctioned?
How many of his motions/lawsuits have been thrown out of the courts?
I see, so it's the 11th Circuit's 3 republican judges, 2 Trump appointed, 1 Bush appointed who are really the incompetent ones, not counting all the Republican and Trump appointed judges who threw out Trump & allies 2020 election lawsuits.

Judge shopping when you're an ex-president and get the judge that you appointed does not equate to this "equal fairness for all witnesses"" that you supposedly have solutions for.
Defence attorneys review prosecutor's evidence and visa-versa and the judge rules what can and can not be entered as evidence.
Don't like it then they can appeal the judges decision.
So the annual 10's of thousands of drug dealers who had their drugs seized, lab tested as being positive would be entitled to a Special Master, who's supposed to to do just what with the evidence?
A Special Master for everyone, in the words of Oprah "you get one and you get one"
Again, irrespective of whether they judge shopped or not I think a special counsel or really, any independent firm reviewing the items seized for proper classification is neither improper nor immoral. I think it's fair to all defendants involved, and I don't think a special counsel/independent law firm is any more corrupt than the DOJ who could plausibly plant false evidence on a criminal defendant for example(and before you sidetrack, I'm not saying that's the case with regards to the Trump incident, he's not making that claim either. I'm just saying that you could clear up even those type of conspiracies with independent review.)

Are you being willfully obtuse? He's not making those claims now. Even if I had said 'the claims he once made', the point would still stand: You could literally eliminate such claims, through an independent 3rd party. We are not, right now speaking of the current case. I am speaking of the benefit of an independent counsel, were it granted to all criminal defendants.
And the main benefit is that it would be impossible to claim falsehood, or deception within the eyes of the independent investigator/reviewer.
Those declassified documents were never distributed. If they were floating freely around, why would Trump sue to get them back? Biden doesn't have to know specifics. All he has to do is think reclassify all documents at marlagao and boom, it's reclassified.
