An international tribunal in The Hague delivered a sweeping rebuke on Tuesday of Chinas behavior in the South China Sea, including the construction of artificial islands, and found that its expansive claim to sovereignty over the waters had no legal basis. The tribunal also said that Beijing had violated international law by causing severe harm to the coral reef environment and by failing to prevent Chinese fishermen from harvesting endangered sea turtles and other species on a substantial scale. The landmark case, brought by the Philippines, was seen as an important crossroads in Chinas rise as a global power. It is the first time the Chinese government has been summoned before the international justice system, and the decision against it could provide leverage to other neighboring countries that have their own disputes with Beijing in the South China Sea. But while the decision is legally binding, there is no mechanism for enforcing it, and China, which refused to participate in the tribunals proceedings, reiterated on Tuesday that it would not abide by it. The award is invalid and has no binding force, the Foreign Ministry said in a statement. China does not accept or recognize it. The five judges and legal experts ruled unanimously, and the decision was so lopsided in favor of the Philippines that there were fears in Washington about how angrily the Chinese leadership would react. Some experts on China cautioned that a modest reaction from the United States would be wise.....snip~ http://www.nytimes.com/2016/07/13/w...s&WT.nav=top-news&_r=1&mtrref=www.nytimes.com What do you think about the advice of the US giving a Modest reaction to this. China has lost face.....and its not thought that there will be no reprisals. What say ye?
China loses So. China Sea dispute... U.S. urges all countries to adhere to South China Sea ruling July 12, 2016 | WASHINGTON (Reuters) - The United States said on Tuesday that an arbitration court ruling that China has no historic title over the waters of the South China Sea should be treated as final and binding and not as a reason to raise tensions.
china wont be the first or last to ignore Hague ruling, all you need to do is google it and see how many these cases has been ignorant by other countries. example Nicaragua v US case in the 80s, current Timor-Leste vs Australia dispute, many more from other countries, and US never ratify UNCLOS which make it harder too. The powerful will always bullies the weak to an extend. i only hope since the current Phillippine president seem want to negotiate with china, that they can skillfully use this result as bargain chip against china in order to get a decent deal. (last one was more confrontational without economy/military to back it up).
Yet, it doesn't seem like the Chinese want to negotiate. Moreover, they are aware of the Troops BO peep put in the Philippines. Plus the bases we were given. Doesn't seem like BO peeps spokesman was giving a modest statement. Does it?
actually they are negotiating, Malasia is good example, they have dispute with china, but their relation is less tense compare to china vs phillippine. Malasia has back door talk with china, they also has some largest investment from china, probably due to these negotiation. As long as the current phillippine willing to talk behind with china, china will entice them with billions $$$ investment
This will show another time what a farce international law is, Hague made its decision now let them enforce it.
So does Vietnam and Japan. They had negotiations with China to. China didn't listen to much. - - - Updated - - - Yeah.....so we can expect China to just ignore it.
Duterte tries to defuse tensions with maritime sanctuary... A Philippine official says President Rodrigo Duterte will issue a formal order declaring a sprawling lagoon in a disputed shoal a maritime sanctuary where Filipinos and Chinese will be prohibited from fishing. Xi did not say whether he agreed or not to Duterte's plan in the Scarborough Shoal. But one thing we are certain is that all the fish in the area will definitely welcome the good news.
China has lost face but Uncle Sam, Samurai Japan and other Western countries have to hide their faces. It will come as a surprise if Japan, the US and other Western countries do not realise that the tribunal's ruling on the South China Sea dispute is a big blunder with global ramifications. The tribunal's ruling implicitly annuls the legality of the exclusive economic zone (EEZ) of 200 nautical miles claimed by those countries around their "rocks" and artificially built islands. One good example is a couple of uninhabitable rocks within Japan-administered Okinotori atoll that is reportedly around 100 square feet in combined area — or no bigger than a bedroom — at high tide in the Philippine Sea. According to https://www.washingtonpost.com/news...a-tokyo-bedroom-but-the-basis-of-a-big-claim/ "...Japan and other countries have criticized China’s frantic island-building in the South China Sea, including piling sand onto reefs to create islands, constructing military installations and airstrips on these man-made islands, and refusing to accept the international arbitration of territorial disputes initiated by the Philippines. While Tokyo’s island-building activities on Okinotori are not as extensive as Beijing’s efforts, the unilateral declaration of a Japanese EEZ to circumvent international law and arbitrary detention of Taiwanese fishing vessels around the islet are problematic. Beijing is likely to exploit the obvious double standard in Tokyo’s position on Okinotori to defend its own activities in the South China Sea." http://www.nbcnews.com/news/world/o...uarrel-over-bedroom-sized-outcropping-n565846 https://www.stratfor.com/sample/analysis/okinotori-odd-place-maritime-dispute http://media3.picsearch.com/is?LAzlcCDeEZOO5QI21oJ-S1WuEjh1UqsB8NnXYcNzf_E&height=186
Of course China does not care what The Hague says. China just emulates what Japan, the US and other Western imperialist powers have been doing all this while. If The Hague really wants to be fair and means what it says, it should hold a "World Conference on all 'rocks', atolls, reefs and islands".
Vietnam is moving Rocket launchers onto their Islands and reefs. Japan is also planning to put a port in Vietnam to counter China.
It won't be surprising if China is planning to build a port in space for spaceships to counter Japan and Vietnam.
