    But at this point none of this matters as the current iteration of the SC is being bought and sold and the right is actually not only ignoring the blatant use of ideology over law in there decisions, but to now be outright supporting it.

    Republicans would do it. The garland thing was long before the election. Trump's last nominee was long after that equivalent point. Republicans don't get to cry foul. They play dirty. Dirty players don't get to legitimately whine if the other side thinks about doing the same.

    I've already made my position crystal clear on the matter of any president and his party's ruling cohort in the Senate making a fundamental decision of crucial, long-lasting importance to the nation a mere three days AFTER the national election involving both the presidency AND the Senate -- which that president LOST, along with his party's majority rule in the Senate! You excoriate Republicans for what you think is a deplorable lack of ETHICS?

    Oh, but you unctuously suggest that Democrats should now learn to be more 'like them'...? Well -- take heart -- if the Democrat High Command force (yeah, FORCE) Sotomayor to resign so that they can bring in some 'young blood' radical to take her place, they'll have easily eclipsed any evil thing the Republicans have pulled in a very, very long time! (Nixon, maybe...? :wink: )

    And, the reason I suggested BACK IN APRIL that the 'Crats might stick Kammy in Sotomayor's place was so they'd have a dignified place to put her where she could fully support liberal agendas for decades, and not wreck the Democrats' chances of winning the 2024 election. It would have been a GENIUS maneuver, because it would have given Democrats a solid rallying point (Joe Biden), with no controversies, no internal grumbling worth mentioning, and put the focus on lots of welfare goodies to promise Democrat voters. Also, it would have precluded any possibility of Kammy mucking up the race with her witless 'word-salad' utterings and prior record of ZERO performance on the one job she was given (by Joe) -- that of getting the border situation straightened out and under control!

    Biden and Schumer could have ensconced former California Atty. General, Kammy Harris in a Justice's chair just as fast as Trump got Amy Coney Barrett onto the SCOTUS -- but THEY DIDN'T. Now, for anyone who isn't a scumbag, it's too late to try to pull this kind of after-the-election crap.

    Afterthought: A very short time AFTER he became Chancellor of Germany in 1933, Adolf Hitler demanded and was given an "Enabling Act" (Ermächtigungsgesetz) which was NOT part of the campaign platform he ran on BEFORE the fateful election that brought him to power. No -- it wasn't until AFTER the election that Hitler pulled this deceitful, scumbag trick on the German people... but, they just let him get away with it. And, as the world has learned since then, "Whatever you tolerate, you get MORE of...." The gullible Germans found that out all too clearly in the years that followed! :roll:

    Incorrect its now being used reasonably where everything the left touches becomes ideological in its decision making.

    Now, I dont blame the right if they do decide to do to the left what was done to them...its fair play. But I suspect they will just MAGA.

    According to the Dean of Notre Dame-Barrett was the best student in thirty years at this top 20 law school. Kackles on the other hand, needed affirmative action to get into Hastings and was a mediocre student.

    I didn't say being like them by being immoral! I said by ATTACKING! Trump won attacking Harris by LYING about sex change operations, the economy... And Democrats failed to attack Trump by telling people the TRUTH about the fact that he is a rapist and a convicted felon.

    A President making an appointment during his four year term is NOT immoral. The Senate REFUSING to fulfill their constitutional duty to submit the appointment to vote IS.

    It’s LAUGHABLE to claim the SC did anything on behalf of the left. The right bought and sold the SC and now are on a retribution tour.

    Congress does indeed exert considerable authority over the Judiciary, and that's been clear for 156 years. Congress enacted the Judiciary Act of 1869, and by having 'carved in stone' the number of Justices at nine, Congress (actually, the Senate) took upon itself the responsibility to maintain that requisite number of Justices... and to truthful, there is no specific, black-on-white language in the Judiciary Act of 1869 that covers the topic of whether or not candidates should be considered for confirmation on the basis of elections in the future, or in the past.

    Thus, there is admittedly a legal 'vacuum' regarding what Democrats should or should not do with regard to the 'Sotomayor situation'. And, in fairness, if we assume that it is unethical for Democrats to force her out and fill the seat with another liberal Justice AFTER last week's election resulted in commanding Republican victories, it must also be accepted that trying to fill that 'vacuum' AFTER all this has come up would also be unethical. So, bottom line, the dismal truth is that if Democrats want to 'encourage' ( :roll: ) Justice Sotomayor to retire so that they can bring in "new blood" to take her place, then it must indeed be legal -- but I still think that it is unprincipled and unethical as hell. I would say that even if the situation were completely different, with Democrats winning a 'trifecta' in this election and with the Republicans smoldering in abject defeat.

    So, there it is... and I fully expect the Democrat 'High Command' to try hard to pull this off. But the danger they face is that if FOR ANY REASON the Senate should fail to confirm Sotomayor's replacement before concluding its business this year, then the decision about who to nominate will become the responsibility of President Trump. As I understand it, because 2025 is an odd-numbered year, the new Congress would take over on January 3rd.

    What makes you think it is a "MOOT point", Andy? Democrats have been sending up these 'trail balloons' since late last winter. I took note of them in March and started posting about the possibilities in April right here in the Forum. Now that the election's over, the 'trial balloons' are up in the air again. Your story talks about 'sources say', but who are those sources? The same ones who send up the 'trial balloons', or some different bunch...?

    "It ain't over until it's over", Andy, and knowing both Democrats and Republicans as well as we all should know them by now, I wouldn't doubt for an instant that Democrats will try to get rid of Sotomayor and her well-known health issues, and quickly bring in some 'young blood', if they think they have even a ghost of a chance of pulling it off. After all, it would be the 'expedient' thing to do -- because politics is all about expedience... and obviously, not ETHICS!

    Well, it's 51 more days from now until January 3, 2025 when the new session of the Senate begins. We'll see what the Democrat High Command decides what Sotomayor may or may not 'volunteer' to do between now and then.... :juggle:

    Repubs would do it toooo. lol you guys are getting ridiculous, you don't force freaking SC justices out because you lost an election. If you win one you damn sure can stop a nominee it if you have Senate majority.
