The U.S. Supreme Court will strike down the landmark ruling in abortion case Roe v. Wade, according to a draft majority opinion written by Justice Sam Alito.

“The Supreme Court has voted to strike down the landmark Roe v. Wade decision, according to an initial draft majority opinion written by Justice Samuel Alito circulated inside the court and obtained by POLITICO.”

“The draft opinion is a full-throated, unflinching repudiation of the 1973 decision which guaranteed federal constitutional protections of abortion rights and a subsequent 1992 decision – Planned Parenthood v. Casey – that largely maintained the right,” Politico reported.

“Roe was egregiously wrong from the start,” Alito writes. The entire draft opinion can be read below:

his is criminal that this was leaked. The ethical breakdown is beyond words and is devastating to our rule of law and the courts. I haven’t even gotten to the the meaning of the draft or if it is even remotely the final decision. It is remember a February rough draft.

    Conservatives are dangerous people.

They are proving it once again.

The majority of voters are right to be afraid of you.

And there will be a huge political price if Roe vs. Wade is overturned.

I think that the first draft of the Obamacare case also struck it down, then Roberts changed his vote. Drafts are called drafts for a reason, they are not final.

Leakgate: Where did the leak come from?
This is a political attack on the Court to pressure a Justice(s) to change their vote.[/QUOTE]

You've been a member of this political forum for 7 years and you're still unable to measure the impact that a decision like this will have on the GOP?

    Take a good look.

So I guess you will be endorsing rioting if Roe vs. Wade is overturned (even though Roe V. Wade being overturned won't change anything immediately).

Because those that like it won't vote for them anymore?

Because those who like it are much less numerous than those who don't like it.

The radical right truly has the worst sense of timing as any group on this planet. Women are women before they are republicans.

    1. there is nothing in the constitution that gives a right for a women to---"murder"---her unborn child.

    2. there are at least 25 states that will keep the right to a abortion. so abortion will not go away.

    3. if this leak is correct (which "every") staffer in the supreme court should be fired. it will be up to each individual state to decide if they want to condone "abortion".

    4. now it is up to the voters to decide!!! not the supreme court, or congress. the voters in each state will decide. that is the way it should be. :)

I agree there will be a huge political price, very likely Biden will pack the court, then the GOP will pack the court, and every change of government thereafter it will simply change parties as they add enough members to gain a majority.

And yet, despite my being pro-choice, I would support a decision overturning Roe v Wade. It's simply incorrect reasoning. It's opposed to the text of the constitution. Repeal it and get a popular movement together to pass an actual amendment.

An amendment isn't required. Just codify Roe at the federal level.

Exactly. Overturning it simply returns the decision to each state to make via legislation or initiative.

That can and will be changed back and forth every time congress and the President change partisan control. Leaving it to the states is really the only decent option.

Under what Federal power? Could use the commerce clause I guess, that's pretty much a blank cheque at this point.

That is what I understood reading the reports under the initial hysteria.
The equally weighted story here is The Leak...who and why.
Seems you can't do anything these days without someone shattering the discretion normally allotted to important constitutional bodies.
