    That's true even if there is a MARRIAGE, regardless if genders. If a will is disputed, it all comes down to the best attorney.

    Had they given each other POWER OF ATTORNEY= PROBLEM SOLVED. Try effective planning.

    Then cite the LEGAL RIGHTS, ENCODED IN THE LAW, that are for married couples ONLY, besides a tax break.

    I will say that gay or straight this can happen even with a will and without getting too detailed, where the will is kept, the state of mind of the individual at the time it was created...all go into whether or not it can be challenged.

    People need:

    Succession planning
    Revocable trusts
    Living wills
    Will and Testaments


    And all of these need to be kept with an attorney for safekeeping. People lose them all the time. The current "marriage" benefits/laws do not substitute for these documents...yet another reason to remove the FG from the equation, have the SCOTUS kick back DOMA, move to state issued civil contracts, and people will have a much easier, less stressful management of their golden years PLUS those going through dissolution or custody cases will have their "rights" spelled out.

    Marriage is a contract made with the respective State government and in effect until death. Federal tax benefits are determined by the Federal Government since that is the only jurisdiction they have.

    When it comes to a will, again that is a Contract issue and any disagreement will be determined by the court.

    One thing I have found throughout the years is that when families are involved it can become nasty business. I have been lucky that I have not experienced family squabbles as both my sister an I detest the pettiness that crops up when someone dies. We both detest the envy and fighting over family issues.

    Not buyin' it. A person with power of attorney SUPERCEDES THE EXECUTOR,if they are not, also , the executor themselves, which, they usually are.

    Sounds like they left too much to chance, to me.

    If what you claim is TRUE,and they had given EACH OTHER LEGAL POWER OF ATTORNEY, your cousin should sue the CRAP out of his late partner's family, and take custody of his remains, as well.

    The left is going to just keep on with this meme until they find something that sticks. there are a lot of good americans out there that are sick of this technique but that doesnt mean that the media and the left won't keep it up just for the fatigue factor. That's how evil works. That old saying, and i'm paraphrasing, ' evil succeeds when good men ignore it.' We can't afford to drop our guard. We can't afford to ignore evil. It's all around us. It sits in the senate and in the White house.

    Wow. That picture is really stupid for a multitude of reasons.
    a.) The Constitution does not address sins.
    b.) Just because the Constitution does not "say" something is a "sin" is meaningless, and not just because it does not address sin. Know why? Because the Constitution was not meant to provide every law. No what else is not a "sin" according to the Constitution? Murder. Know what else? Rape? Are these okay because the Constitution doesn't call them sins?
    c.) True the Constitution doesn't make any reference to gay marriage. Know what else it doesn't reference? Abortion? And yet your side has no problem making national laws about that.. Hmmm... I wonder what the Constitution says about being a hypocrite...
    d.) The Constitution does mention gay marriage, in an indirect way. The Constitution gives the power to license to the States. What are some things that get licensed? Let's see... liquor stores, drivers, hair stylists, annnnnnnnnd... oh yeah! Marriages. So the issue of marriage is left explicitly to the States. Well then why don't different States have different laws about marriage... oh wait...

    It is nice to see someone on your side actually reference the Constitution in what was an attempt at a positive way. Just, in the future you may want to read it. Then you may actually know what you're talking about...

    Anyone working in retail is in a bad position- I feel for anyone who has to deal with the general public.

    But then you'd agree the CEO of Starbuck's puts his employees in a bad position, right?

    You drank a lot of mercury as a child, didn't you. First off, if the GOP spits in the face of veterans, why are Vets and active duty servicemembers so disporportionately Republican? So you are essentially saying that Vets are too stupid to decide what is good for them. Sounds a lot like spitting in their faces to me. But your opinion is not proved stupid solely by veterans. It is proved stupid by Democrats, It is demonstrably true that the Left hates the military. This is the very reason that the Debt Ceiling went down the way it did. The way that the deal was made appealing to Democrats was by including cuts to the military. If the Democrats didn't hate the military, why would big cuts to the military be the only way to attract them to the deal? Oh yeah, because you have no idea what you're talking about. Also, after running and governing solely on the idea that everyone needs cheap/free health insurance, Obama proposed making veterans pay more for health insurance. So your side wants everyone to have cheap/free health insurance... EXCEPT VETERANS. I was going to call you stupid, but no one is stupid enough to make the moronic claim you did. You are clearly schizophrenic, you are completely broken with reality. The only veterans your side cares about are Red Army vets from the former USSR.
