    You are correct - the issue was never put before the court on appeal and so the court did not consider or address it.
    Anyone who says otherwise doesn't know what they're talking about, or they're trolling.

    Dick’s May Have To Close Stores Due To Anti-Gun Decisions

    CEO Edward Stack explained that the 3.9 percent decline in the company’s sales during the third quarter is part of its ban on the sale of assault-style rifles and on the sale of all firearms to customers under 21 years old.

    In addition to the firearm-purchasing restrictions, Dick’s also hired a number of Washington, D.C. lobbyists in May to advocate for more-stringent gun-control regulations. Taken together, the restrictions and the lobbying effort led the National Shooting Sports Foundation to expel Dick’s and caused a number of major gun manufacturers to sever ties with the retailer — developments that Stack admitted were detrimental to its third-quarter performance.​

    Dick's would have been fine if they just quit selling ARs. Their problem was that they made a big deal about it, alienating a lot of customers and suppliers with politics. They also canceled delivery of all ARs that they had on back order. They refunded the customers, but during that time the price of ARs more than doubled and their customers missed their opportunity to buy their AR at a good price because Dick's canceled their purchase.

    Those who decide to put political ideology ahead of maintaining a business and making profits. The two standards are mutually exclusive to one another.

    While them making a big deal about stopping selling ARs did kind of irritate me, I could have forgiven them for that--that's justified under business reasons. What was unforgiveable for them as a company was their hiring gun control lobbyists. That was a slap in the face for pro-gunners. I haven't shopped with them since then, and I used to be a pretty good customer.
