    How about that! TDS works! We're finally getting a prosecutor for Trump's crimes. Justice is slow but inexorable.

    Right about now I can see Trump loyalists trying to find something... anything... to attack the newly appointed special counsel.

    Jack Smith, the former chief prosecutor for the special court in The Hague, where he investigated war crimes in Kosovo, will oversee the investigations.

    Oh oh... A human rights expert. Right there I'm sure the Trump media (if there is any left) will find fertile grounds to deny everything. I'm not sure how... but they'll find a way to fit it in.

    We have yet another special counsel, here's hoping this one actually leads to something concrete and meaningful. But I digress, almost nothing the government does even in the justice department is concrete and meaningful.

    It is funny though. "To show the veener of impartiality, which certainly isn't stepping down like Sessions did. We will appoint a special counsel to pursue the case WE opened up". I watched the MSNBC lawyer on this, and she was right on the money, This action cannot and won't come close to establishing a form of independence.

    That said, I don't mind them pursuing the investigation provided they indict if there's an indictable case and prove beyond a reasonable doubt as to his guilt.

    It would be much worse optics to not have a special counsel. The whole point is to put a little distance between Trump and the DOJ.

    Its a special counsel. Not a special judiciary. All they've done is divorce the official members of the DOJ from the investigation by creating a "chinese wall".
    I'm not aware of a better solution to investigating potential criminal acts of a person running for or holding office

    At first I thought it would be a big delay, that the new SC would start all over again, but that isn't the case, they are just going to review all the work that has been done and build from there. This Jack Smith guy seems like the right guy for the job.

    One thing is for certain, this one won't be limited by any "OLC memo" and there may be others, perhaps many others, who are indicted, and they don't appoint a Special Counsel if they were considering not to prosecute.

    But, there will always be, in the peanut gallery .....

    Hmmmm Why didn't the director of the FBI make this announcement?

    "Although there is evidence of potential violations of the statutes regarding the handling of classified information, our judgment is that no reasonable prosecutor would bring such a case. Prosecutors necessarily weigh a number of factors before bringing charges. There are obvious considerations, like the strength of the evidence, especially regarding intent. Responsible decisions also consider the context of a person’s actions, and how similar situations have been handled in the past.

    In looking back at our investigations into mishandling or removal of classified information, we cannot find a case that would support bringing criminal charges on these facts. All the cases prosecuted involved some combination of: clearly intentional and willful mishandling of classified information; or vast quantities of materials exposed in such a way as to support an inference of intentional misconduct; or indications of disloyalty to the United States; or efforts to obstruct justice. We do not see those things here."

    There was nothing in the OLC memo preventing Mueller from bringing a criminal referral how many times do you have to be told that.

    A prosecutor isn't going to indict because he or she believes in their guilt, they will indict solely based on the facts and applicable law but more importantly, whether they believe they can convince a jury of guilt, that they can sufficiently overcome any argument by opposing counsel. They have to be remarkably confident they would win in a case where the stakes are high as this, where the eyes of the world will be upon them.

    I don't see that this makes much difference.
    Facts are facts, but I don't care for the Jan 6th stuff and the document case being conflated. They are separate, and should remain so.
    The document case is, imo, almost open/shut case. Not much to really argue about.
    Trump's legal liability in Jan 6th, as un-American as it was, is a lot more cloudy.

    Well... one thing is for sure: no matter what happens it couldn't possibly be less fruitful even if it turned out that Jack Smith was a Trumpist.

    The problem with it would be that would be incorrect. There clearly WAS intentional and willful mishandling of classified info and there were vast quantities and there are clear indications of obstruction of justice.
