"LAWYERS representing the jailed former speaker of the Catalan parliament are to use legal arguments from Scotland, Germany and Belgium when they raise her case with the European Court of Human Rights in Strasbourg."

Jailed Catalan parliament speaker to use Scots legal arguments, The National, the Newspaper that supports an independent Scotland.

The speaker of the Catalan Parliament, Carme Forcadell was imprisoned for allowing a debate and vote on independence

The imprisonment of Carme Forcadell in Spain is unlawful, contrary to human rights law,
therefore her lawyers should report her unlawful imprisonment to the European Court of Human Rights, pleading that the court does issue a writ of Habeas Corpus, addressed to King of Spain and to the Spanish Constitutional Court commanding that their prisoner Carme Forcadell be brought before the European Court of Human Rights for determination of whether or not her imprisonment is lawful or unlawful and if "unlawful" to release her from custody.

Should the King of Spain and / or the Spanish Constitutional Court refuse to order that their prisoner Carme Forcadell be brought to the European Court of Human Rights then the King of Spain and / or the Spanish Constitutional Court could be charged with contempt of court - contempt of the European Court of Human Rights, which could issue a warrant for the arrest of the King of Spain and / or the Spanish Constitutional Court to answer the charge and if found guilty, punished accordingly.

"Habeas corpus (Medieval Latin meaning literally "that you have the body") is a recourse in law through which a person can report an unlawful detention or imprisonment to a court and request that the court order the custodian of the person, usually a prison official, to bring the prisoner to court, to determine whether the detention is lawful."

    PS.
All my love to Carme Forcadell, to the people of Catalonia and Spain. My best wishes and those of every anti-fascist in Scotland and throughout Europe be with you always.
