More dual nationals face losing Australian citizenship, after Neil Prakash's case
    https://www.sbs.com.au/news/more-du...tralian-citizenship-after-neil-prakash-s-case

What do you think about this?

"The Melbourne-born man, who is currently in jail in Turkey over charges related to being a member of Islamic State, has become the 12th dual national to have their citizenship annulled over associations with offshore terror groups."

I am worried by Peter Dutton being able to try and judge accused people, in absentia, and then strip them of Australian citizenship.
(I hold no brief for Neil Prakash, but he is still awaiting trial in Turkey and under Australian law is presumed innocent until proven guilty)
The implications of being stateless are troubling.
We have in Australia, in detention, many people who are stateless. What is to happen to them?
The implication of Peter Dutton being able to wield this sort of power is also troubling.
Will a Labour government be able to reverse this? The Labour Party doesn't have a big moral voice to speak up on things like this any more.

It's about more than that. The minister has the power (one man) to remove someone's Australian citizenship. When will the parameters be extended to include other less than desirable people? You know, thin end of the wedge stuff.

Born in Australia and stripped of citizenship? That should not be permitted.

Due process. I also need to ask what it's supposed to achieve, given he's in Turkey on trial and likely to get banged up for a few years. When he gets out he's deported and extradited to face trial in Australia. So the stripping of citizenship seems a bit of a wank by Dutton.

And I ask, if he is born in Australia how come he can he stripped of his birthright?

This will more than likely end up in court, sponsored by civil liberties Australia. From there who knows?

This is a political move by Dutton and the Libs, knowing full well the majority of average Australians could care less what happens to this fool.

It is however designed to place internal pressure on Shorten from his increasingly impatient left. If he says nothing their disdain for Sellout Billy will rapidly increase causing future destabilisation once taking government. If he calls Dutton on constitutional grounds, and he would be theoretically correct for doing so, the public backlash could be massive and give the Libs the advantage they have been looking for. Nobody scaremongers quite like a desperate conservative.

Billy boy wants the lodge so bad he will likely wear the wrath of his left and leave Dutton to it. However his silence will likely widen the idealistic gap between the left and his central faction.

The government of the here and now is growing and our grudging dependence upon it is becoming concerning. When we ignore the civil rights that we ourselves take for granted because of our disgust at anothers behaviour, we inadvertantly help tie the noose for our own throats. Plenty of monsters have been born here and have committed just as heinous a crime as Prakash, some worse, but they retain their citizenship. Prakash is an easy target because he isn’t in the country. Easier to stop someone coming back in than to kick them out.

Any terrorist should not be allowed back into Australia..simple as that..
Any terrorist, no matter who he is, or where he is, has no rights..he gave up his
right to due process when he became a terrorist.
All this crap about due process is just crap..typical loony left crap about
    rights....

Actually I don't think they can, I think that you will find we have to take him back and imprison him.
I am sure firstly that you cannot revoke a birthright and second I don't think you can leave a person stateless

If you want to go fight for another nation against Australia, then YES it should be permitted. Terrorists should have no rights at all.

Yes this may be correct, however now that Fiji has denied Prakash has ever been a citizen it seems Dutton may look extremely foolish. A rod for his own back it seems.

Turkey will likely imprison him and possibly execute him, as I believe recent changes to their legal system now sanctions capital punishment for Terrorism and child rape. I may be misinformed but I thought I had heard that somewhere. If they don’t..........

And you are correct about his return point, Australia must take him back or risk international condemnation on releasing a known terrorist back into circulation.

Shorten remains silent. It is deafening!

Shorten is wise to stay out of this. Dutton is doing the job of the Opposition.

From a public point of view yes, however from a party point of view he is only creating a bigger divide between himself and his left.

Please forgive me for doubting your much more knowledgeable self, but are you sure? I thought that the only reason even dutton thought he could do it is because he was a dual citizen with Fiji.

Why Australia would leave it to Fiji to have to take him I will never know.

Maybe you could enlighten us a little more.

Make no mistake. Dutton is not the idiot you think he is. This is politics.

This is the government searching for a glimmer of hope. In fact it is smart politics in one way, but dumb in another.

You will see this issue ramp up very soon, as the Libs try in earnest to get Shorten to comment. And Shorten will need to comment!

Shorten could take the fence sitting approach and pass it back claiming it is a government decision, hoping like crazy it won’t resurface until after the election where he will begrudgingly give in to his left and take posession of Prakash. He will then have three or so years for the public condemnation to quiten down.

He could make the bold statement to the public saying he will uphold Duttons decision. Ensuring his election as PM and hoping the left do forgive him in time. This is highly unlikely, as he will lose the party room and will only remain as leader at the good grace of the unions as they are the wallet of the ALP. A limp PM, suffering Turnbull Syndrome.

    Or

He could back his left and bring Prakash home to face trial. Highly unlikely, as this one decision will have major ramifications across a swathe of electorates not just the close ones. This is the decision the Libs want him to make.

Dutton has put Shorten in a sh!t of a position here, damned if he does damned if he doesn’t.

He will likely go full Turnbull and sit on the fence and hope he sees the election in to gain power. Problem that Back Door Billy has is he is likely to inherit this issue and as it is tied to border security policy he will have to comment. And border security is and always has been the ALP’s achilles heel.

Dutton will pin his re election hopes on this issue and expect him to call Shorten out on return of Parliament.

In my opinion this is great politics, but only politics as Prakash will be found guilty and executed in Turkey. What better way to send a message than to catch, and kill the public face of ISIS. Erdogen would be hero, and he loves being hero.

By international agreement, anybody deported form any nation is sent back to the place of departure. Since that wasn't Fiji either the only way he will be sent to those nations is if government puts their hand up and accepts him and he accepts AND/OR Another nation does not partake to have him face charges in another nation which will be up to the legal system of Turkey, not Australia OR Fiji.

Now since you want to try and pretend your superiority on this, I will point out that this was an agreed action around the world to insure that people would not be sent into a nation where they will be persecuted or even killed should they not be accepted for asylum. This has been a convention for some years and part of the refugee accord from the UN. One who pretends to be somewhat educated above the rest on immigration matters, I would have assumed you were aware of these things so explaining them would not be necessary. BUT hey, I don’t run and hide when I get things wrong…
