    Well, I actually think the shooter should be guilty of a crime in this case.

    I’m not sure if they are guilty if a crime here, because I am not an expert on the law involved.

    I just think what the shooter did here should be a crime.

    Black men, yes. Hispanics? No, absolutely not. Hispanics are probably on course with just as many bad white men.

    Why, you ask? Cultural differences. It’s in the DNA. Are all dogs the same? Do all breeds act the same? Of course not. A Doberman is more inclined to be violent then a Pointer (hunting dog). Both dogs, but both are wired very differently. It’s in their blood.

    The same can be said about Africans. It’s in their DNA. They do this in Africa, the Americas, Europe, etc… Wherever you have a large percentage of blacks, it is a fact that trouble will follow. Chicago, Detroit, Atlanta, DC, Baltimore, etc, etc, etc are all living proof of this in the US. The evidence is in your face. You just choose to ignore it and scream “racist” instead.

    Yes, they charged Wilson with aggravated assault. I addressed that in my previous post. I even provided the legal definition of aggravated assault in Georgia.

    Essentially, yes. They may not be doing it consciously, but every time they make a choice that empowers a gang, or short-changes the education of their peers or themselves, that's what they're doing. In small increments, they're creating a community dominated by gangs with inadequate education via lots of little choices made by individual members of the community. In third grade, when they choose to blow off doing their homework and would rather play Xbox with their older brother (and their parents - or more likely parent / grandparent / aunt / legal guardian - choose to do nothing about it), that's what they're choosing. In 7th grade, when they get in a fight at school and beat up some other kid for "acting white" because he studied hard and gave the right answers in class, that's what they're choosing. In 11th grade, when they choose to drop out to join the neighborhood gang rather than finish high school, that's what they're choosing.

    They don't do it all in one fell swoop, and not all of them do it, but enough of their aggregate choices add up to empowering and strengthening street gangs and devaluing their education that a community dominated by gangs with inadequate education is the outcome. And it's the outcome of their choices.

    They used their car as a deadly weapon, trying to run the defendants of the road. It's much worse than a skateboard.

    Can you show us exactly what study has been produced that it's in their DNA? I think you're just making it all up out while pushing an extremistic far white wing nationalistic idea.


    Speaking of which... can you tell me what skin color people had that basically oppressed the entire world under a thug colonial rule where murdering who opposed was justified, slavery was implemented all over, just like raping them was not illegal due to their utterly racist point of view. Can you also tell me what skin color the people had who raged war all over the world twice, invented a way to commit genocide on an industrial scale, and later found the need to be able to nuclear bomb the entire planet multiple times? Can you tell me what the dominant skin color is of the countries with the biggest weapon industries?

    It's all and the same white skin color, aint it?

    I agree. I am simply trying to gather information at this point to determine the validity of the assertion of the defense. it seems preposterous that a passenger was a threat as well. We shall see what logic pretzel the defense tries to craft from these facts.

    When were they or their truck searched for firearms or lethal weapons?. They weren't even breathalyzed even though they were drinking in the truck.

    If my memory serves me this was one of the arguments presented during the Kyle case. The prosecutor argued that Kyle used full-metal jacket bullets thus endangering the lives of others. I believe the defense cited case-law where if in the act of legitimate self-defense others are endangered a case cannot be made for reckless endangerment. I believe during the trial we'll see this argument played out again.

    I believe the real problem the defense has is when the defendant started firing bullets would a reasonable person be in fear for life or serious bodily injury. It sounds like the other car may have yelled some mean things and perhaps swerved at him and/or cut him off. When the other car did this it is possible he did fear for life or injury. But did that threat still exist? The other car was at this point in front of him and it seems they were no longer a threat. They weren't slamming brakes or moving into the other lane to do this maneuver again. They were driving in front of him and it appears that road rage took over. He could have slowed down but instead he chose to wildly fire bullets at the car in front of him. Best case scenario with the facts as they stand, sounds like murder.

    I would have to agree. I do like to try to understand the logic puzzle though. To me, it sounds pretty sketchy given the scenario that you outlined above that there could still have been an active threat and is more likely a rage incident that led to homicide. 2nd degree murder seems appropriate as a charge then. We shall see what the prosecution comes back with for charging and one hopes they are competent to try the case...

    You dont have to be an "expert" of law. There is no such thing.

    "Experts" of law just open a book and view the exact wording of the law, find any cases of precedence they can, and ponder on how to manipulate wording to favor their argument.

    Thats all "experts" do.

    There is no way you can look at the numbers and not conclude that race is almost always a factor, and definitely not to the advantage of people of color. There is what you want and there is what is! Again, who knows? He may be the 1 in 100 that succeed!

    Race is almost never a factor, there is no way you can reasonably look at any of these issues and conclude it is.
