Good grief this lacks understanding. Just because the constitution does not list every single basic right - does not make things that are not listed "Not basic rights".

The principles on which this nation was founded - found in the DOI - principles by which law and the constitution are to be interpreted .. put essential liberty "ABOVE" the legitimate authority of Gov't.

This means the Gov't is to have no authority to make any law that messes with essential liberty - of its own volition.

The second part is "consent of the governed". It is the people that give authority to Gov't - it is only on this basis that the Gov't can make law messing with essential liberty (sans some major crisis requiring martial law).

The bar for consent is "Overwhelming Majority" = at least 2/3rd's Not 50+1 .. and there is no such thing as "Simple Majority Mandate" that some politician getting elected gives them some mandate to mess with essential liberty.

There is no "overwhelming majority" that agrees with banning abortion. The Gov't then has no legitimate authority to make such law .. FULL STOP>

 

Why would you make a bill of rights if your goal was to protect all freedom and only give specific powers to the government, what a silly thing to do.

 

There is nothing silly about the bill of rights - a bill which outlines specific protections and safeguards against totalitarianism.

Nor is it silly to limit the power of Gov't - unless of course one is in favor of Totalitarianism. You are welcome to your opinion that limitations to Gov't power is "silly"... I just do not share that opinion.
