Is it illegal to pay your wife for sex?

This question occurred to me when I read about couples who are doing it. In the couple of situations I read about, the wife had lost interest in sex and it became a chore. So the idea came up that the husband would give the wife some of his share of the household income, for sex. In both cases the women were all over it! Funny.

But, when you consider the legal definition of prostitution, it doesn't specify that the two consenting adults are not married.

It could work the other way around as well. Sometimes it is the husband who loses their drive. But I find it interesting to consider as a fine point of law; if only because the answer isn't obvious. How could this be illegal for a married couple? And if it clearly cannot be illegal, then it would seem to be a form of discrimination against unmarried consenting adults. and therefore unconstitutional.

Apparently some States limit the language to matters of solicitation and avoid the issue of payment for sex.

 

Then marriage would be illegal!!!

 

Don't get me started! I do find prostitution laws indefensible where only two consenting adults are involved. When push comes to shove, I don't think they could withstand a Constitutional challenge in the SC. The logic just isn't there.

 

I find prostitutes one of the most moral people in this country. Those nine mystical beings in black robes thinking they are gods, don't bet on it, Odumbocare was declared unconstitutional but viola... Perhaps you would like this:

Wow! I guess I hit a nerve. Too extreme for me but I appreciate the basic sentiment. It is not the government's job to legislate morality or proper behavior.

I was burned very badly in a 20+ year marriage and could say a lot about what does and does not constitute prostitution. But I won't. Suffice it to say the line is no longer clear to me.

 

I suspect that in a lot of jurisdictions, this is one of the many things that are technically illegal but the authorities would never bother prosecuting.

 

It's funny. Some cities have a stated tax rate for escorts. Even before the internet, they were listed in the yellow pages. And escorts are all over the internet. But from time to time I hear about some big sting operation on the news.

 

Prostitution should not be a crime. Neither should selling your own organs. Neither should suicide. Its your body and your life, you are not owned by the government.

 

Well she could never testify against you for what that's worth.

You should be able to (*)(*)(*)(*) whoever you want for whatever they want. It's a shame the law is still so puritanical.

What sort of wife takes money from her husband for sex? I find it a very sad point of view, one that suggest a woman finds no enjoyment in sex.

 

This is merely a formalised version of the age-old and universal mammalian agreement. Females have always exchanged sexual favours for 'money'.

 

Did you not read the OP? It's specifically about women who've lost interest.

 

Any wife who imagines she's never exchanged special favours for a pair of pricey shoes (regardless of how much effort goes into separating the two events psychologically and actually), is living in fairy land.

You must be talking about dependent wives. I've always worked and I bought my own shoes.
It might be different if you don't work.
It must be tough if the wife is the breadwinner-what would the man have to trade for sex? Washing, ironing?

 

Some wives lose interest after kids/menopause etc. I have friends who happily admit this. Why should they keep doing it just to keep him happy? Just as when these women formerly enjoyed sex, there needs to be something in it for her too. I think it's a great idea ... whether the currency is fiscal or otherwise. "You take me out to X restaurant, I'll provide dessert", etc.

Would be a pat answer if so. Just because a woman works, doesn't mean she is free to buy pricey shoes. I know quite a few well paid women who still have to ask permission. I can't imagine why you think having a job makes any difference ... it's all 'family money'. Its use to be jointly decided. Unless you're in one of those 'pre-nup' type marriages. In which case, you have larger problems.

When you enjoy sex, that's reward enough in itself isn't it?
How much sex is enough to trade for a meal? Do specific "aspects" have greater value than others? Eg. What would be the trade for a Cateaubriand with a top of the line Bordeaux?

 

Well there are plenty of women out there who enjoy sex "after kids/menopause" have you not heard of the term cougar?

I find the exchange of money too cold for a relationship within a marriage, if a woman can only enjoy being with a man when she's been paid then I feel sorry for him and I question whether she's actually worth his time.
